City of Saint Anthony <br /> Housing and Redevelopment Authority 06 <br /> of the City of Saint Anthony <br /> February 19, 2004 <br /> Page=2 <br /> Section 4.1 (a)(ii) of the Redevelopment Agreement provides that the acquisition of the Cub Parcel and <br /> the "SuperValu Leasehold Rights" (as defined in the Redevelopment Agreement) by the Commercial <br /> Developer is necessary to acquire the "Cub Restrictions" (as defined in the Redevelopment Agreement) <br /> encumbering the 'Development Property" (as defined in the Redevelopment Agreement) which must be <br /> extinguished to allow for redevelopment of the Development Property as contemplated by the <br /> Redevelopment Agreement. The Authority agreed that such acquisition was "under threat of <br /> condemnation" and agreed to take such action as may be reasonably requested to document this fact. <br /> Section 4.1 (a)(ii) of the Redevelopment Agreement also stated that the Commercial Developer will <br /> acquire the Cub Parcel and the SuperValu Leasehold Rights by voluntary purchase agreement or,'if <br /> necessary,by condemnation. <br /> St. Anthony Retail has determined that it will be necessary for the Authority to commence <br /> condemnation proceedings with respect to the Cub Parcel and the SuperValu Leasehold Rights to <br /> facilitate the acquisition of the Cub Parcel by St. Anthony Retail. Consequently, St. Anthony hereby <br /> requests that the Authority, as contemplated by the Redevelopment Agreement, adopt a resolution <br /> approving the condemnation of the fee simple interest in the Cub Parcel and the Cub Restrictions <br /> appurtenant thereto, including the SuperValu Leasehold Rights (subject, however, to the leasehold <br /> rights of the tenant occupying the Cub Parcel) and, if subsequently requested by St. Anthony Retail, the <br /> service of a petition seeking the condemnation of the Cub Parcel and the SuperValu Leasehold Rights. <br /> You have indicated that upon this request, the City will provide all required notices and will schedule a <br /> public hearing relative to the proposed resolution on March 9, 2004.
