35 <br /> REQUEST FOR COUNCIL CONSIDERATION <br /> Report Date: June 9, 2004 <br /> Agenda Section: VI, A <br /> Meeting Date: July 13, 2004 (2nd Reading) <br /> ITEM DESCRIPTION: <br /> Amend Dog Ordinance, Section 515 <br /> MANAGER'S REVIEW: <br /> This version contains the amended Immunization for rabies text. <br /> We have added a section 515.05 — Special Multiple Dog License. <br /> This would allow the City ordinance to maintain the two (2) dogs restriction <br /> but residents wishing to possess three (3) dogs could obtain a license with <br /> the following conditions: <br /> a.) Written approval of the occupants-from at least seventy-five <br /> percent (75%) If the residential property abutting the licensed premised. <br /> b.) Fenced Yard: The yard of the licensed premises if fenced in such <br /> a manner as to the restrain dogs on the premised from leaving the yard. <br /> c.) Nuisance: Dogs kept on the licensed premised do not create a <br /> nuisance by excess barking or by creating unsanitary conditions. <br /> d.) Fee: Payment of a yearly license fee of $20.00. <br /> e.) Denial of application: The Chief of Police may deny requests for <br /> renewal of a special multiple dog license based upon complaints received <br /> during the preceding year. In the even of such a denial, the applicant may <br /> within ten (10) days of being advised of the denial, request, in writing, a. <br /> hearing before the City Council on the denial. <br /> These conditions place the responsibility of having the extra dog with the <br /> resident.
