City Council Regular Meeting Minutes <br /> September 28, 2004 03 <br /> Page 3 <br /> 1 City Engineer Hubmer reported that on September 21, 2004 a public hearing on the flood plain, <br /> 2 ordinance took place, noting that he was in attendance to answer questions about the ordinance. <br /> 3 He indicated the Planning Commission recommendations have been forwarded to the City <br /> 4 Council for their review this evening. <br /> 5 <br /> 6 Mr. Hubmer stated the City of St. Anthony is proposing adoption of a floodplain ordinance in <br /> 7 conformance with the recent revision to the Hennepin County Floodplain Mapping by FEMA. <br /> 8 He noted this ordinance is necessary for the City to adopt to remain enrolled within the National <br /> 9 Flood Insurance Program, adding that this ordinance covers land use changes and development <br /> 10 within designated floodplain areas. <br /> 11 <br /> 12 Discussion: <br /> 13 Councilmember Faust referenced the flood in 1997 and inquired as to why individuals could not <br /> 14 receive flood insurance in the years following; 1998 and 1999. Mr.Hubmer responded in noting <br /> 15 that prior to the spring of 1998, the City did not participate in the FEMA program, therefore, <br /> 16 insurance was not available to the residents. He indicated that currently the residents are only <br /> 17 available to half the amount of what is available, $35,000 rather than$75,000, due to the fact that <br /> 18 the City does not fall within a flood plain. <br /> 19 <br /> 20 There was discussion with regard to the flood plain ordinance including both Hennepin and <br /> 21 Anoka Counties. <br /> 22 <br /> 23 Councilmember Stille inquired as to how it is determined what is considered to be a flood plain, <br /> 24 with making reference to the flood in 1997. Mr. Hubmer responded in noting that the flood in <br /> 25 1997 was determined not to be a result of being adjacent to a body of water. He continued in <br /> 26 stating that a flood plain is mapped as a designated study area that has an ongoing history with <br /> 27 flooding; St. Anthony does.not. <br /> 28 <br /> 29 There was discussion with regard to the ordinance allowing for the construction of a flood plain <br /> 30 if desired. It was determined that it would not be necessary,however, the City is required by law <br /> 31 to adopt the ordinance in order to participate in the FEMA program. <br /> 32 <br /> 33 Councilmember Stille noted that in the financial community such regulations also come into play <br /> 34 with regard to applying for a mortgage. <br /> 35 <br /> 36 Mayor Pro-tem Thuesen recited the purpose of the flood plain ordinance for the public in <br /> 37 reading: <br /> 38 <br /> 39 1685.01 Purposes. The legislature of the State of Minnesota has in Minnesota Statutes Chapter <br /> 40 103F and Minnesota Statutes Chapter 462 delegated the responsibility to local government units <br /> 41 to adopt regulations designed to minimize flood losses. The purpose of this Section is to <br /> 42 minimize potential losses due to periodic flooding including loss of life, loss of property, health <br /> 43 and safety hazards, disruption of commerce and governmental services, extraordinary public <br /> 44 expenditures for flood protection and relief, and impairment of the tax base, all of which <br /> 45 adversely affect the public health, safety and general welfare, and to establish eligibility in the <br />
