22 <br /> Employer Provided Benefit Credits <br /> "Flex 125 Plan Only" <br /> What annual credit amount will an employee receive? <br /> Can the credits be converted to cash or must they be used for pretax benefits? <br /> Do all eligible employees get flex credits, or only certain groups? Which groups? <br /> FMLA Option (For consistency, use the same options as you do for all other benefits) <br /> PRE-PAY: Paying pre-tax before the leave begins the amounts that will <br /> become due during the leave out of payroll checks; <br /> AFTER-TAX PAY AS YOU GO: Remitting after-tax payments to the <br /> Employer on or before each pay period during the leave, with all <br /> delinquent payments to be made within thirty (30) days of their due date; <br /> XXX PRE-TAX PAY AS YOU GO: Pre-tax salary reduction contributions from <br /> payments to the Participant (i.e., sick pay, wage continuation, short term <br /> disability benefits or vacation pay) during the leave; or <br /> PAY ON RETURN: From pay checks following the leave on a pre-tax <br /> basis. Participant must make up all amounts owing for Plan Year and <br /> must elect this payment option before the Unpaid Leave commences. <br /> Safe Harbor Rules Related to Re-Employment - Select Option(s) <br /> XXX Participants who return to work within 30 days of termination will <br /> automatically resume their original election unless another intervening <br /> event has occurred which would permit a change in election. A <br /> Participant who returns to work more than 30 days after termination will <br /> be treated as having a change in status and have the option of resuming the <br /> original election or making a brand new election. <br /> Participants who return to work may not resume the original election and <br /> may not participate in the plan for the rest of plan year. <br /> 2 <br />
