Section 15, Subd. 5, 3d of the Zoning Ordinance indicates this <br /> 2 does not nullify the process and the Council may consider the Planning <br /> 3 Commission's findings. <br /> 4 Mr. Shamp requested a 2 foot height variance for the 8 foot fence (6 feet is <br /> 5 allowed). The fence is attached to a deck and could also be construed as a <br /> 6 "screen" whereby Mr. Shamp would not need a variance. <br /> 7 The Planning Commission had recommended approval of the request by a vote <br /> 8 of 6 to 1. <br /> 9 The next door neighbors have both indicated they have no objections to the <br /> 10 "fence." <br /> 11 Several residences throughout the City have similar "fences" but did not seek a <br /> 12 variance. <br /> 13 The three conditions required for granting a variance do not appear to be met <br /> 14 with this request. <br /> 15 The Council must consider consistency with granting variances and whether they <br /> 16 wish to establish a precedence with their decision. <br /> 17 The ordinance should be amended to clarify the definitions of "fence" and <br /> 18 "screen." <br /> 19 In light of these questions, Ranallo felt it would be wise to get an opinion from <br /> 20 the City Attorney regarding the matter. <br /> 21 Motion by Marks, seconded by Enrooth to continue the, request for a two foot <br /> 22 fence height variance by Thomas Shamp, 3209 Edward Street until the matter <br /> 23 is reviewed by the City Attorney. In the meantime, the fence (or screen) may <br /> 24 stay as it is. <br /> 25 Motion carried unanimously. <br /> 26 X. ADJOURNMENT. <br /> 27 Motion by Marks, seconded by Wagner to adjourn the regular Council meeting <br /> 28 at 8:55 P.M.. <br /> 29 Motion carried unanimously. <br />
