• EXHIBIT B <br /> 2. Yes, a particular hardship to the applicant would result if the strict <br /> letter of the regulations are adhered to. J.C. Penney is a 57,000 square <br /> foot department store located at the northwesterly side of Apache Plaza. <br /> This location provides limited signage and storefront visibility for <br /> southbound traffic along Silver Lake Road, and no signage or storefront <br /> visibility for northbound traffic along Silver Lake Road. Although J.C. <br /> Penney has been a tenant at Apache for many years, competitive factors in <br /> the marketplace now require that J.C.Penney maximize its exposure to that <br /> marketplace with additional signage on Silver Lake Road. <br /> 3. Yes, the conditions upon which the application for a variance are based are <br /> unique to the parcel for which the variance is sought and are not applicable <br /> to other property within the same land-use classification. Apache Plaza is <br /> a 530,000 square foot shopping complex, with 3,000 lineal feet of exterior <br /> wall space within the main mall area located on 52 acres of land. J.C. <br /> Penney is a 57,000 square foot tenant which exceeds the total square footage <br /> of most other retail complexes within the City of St. Anthony. <br /> As a matter of policy, Apache Plaza controls both exterior and interior <br /> signage of all tenants in an.attempt to maintain a harmonious appearance of <br /> the shopping center. It is the feeling of Apache Plaza, Ltd. and the <br /> applicant that the proposed signing corresponds with Apache' s attempt to <br /> • maintain the architectural integrity of the complex. <br /> Although Apache Plaza is in the same zoning classification as the other <br /> retail areas of St. Anthony, the nature of the tenancies at Apache and the <br /> size of the complex create a regional scope shopping area, whereas the other <br /> retai-1 facilities have neighborhood orientation. <br /> We respectfully request that the City of St. Anthony Planning Commission and <br /> City Council approve the above request. <br />
