STAFF REPORT <br /> DATE: November 10, 1992 <br /> TO: Planning Commission <br /> FROM: David Mark Urbia, Management Assistant <br /> ITEM: SEPARATION OF UNDERSIZED LOTS HELD IN SINGLE OWNERSHIP <br /> BACKGROUND <br /> When Mrs. Newgaard of 3127 Silver Lake Road approached the City with this issue, It <br /> required some thought of a policy direction. Staff asked the City Attorney to provide legal <br /> insight to this issue. The letter recommended to first review the half-section maps for the <br /> City, then to determine whether there be an ordinance change requiring single ownership <br /> or a grandfathering provision. <br /> DISCUSSION <br /> After reviewing the half-sections, there is a significant number of old plats with very small <br /> lots, where it clearly takes two or more lots to make an adequate home site. From this <br /> observation, and from the City Attorney's advice, it may be wise to have an ordinance <br /> prohibiting the separation of legally platted lots if the lots would not conform to current <br /> zoning ordinances if separated. <br />
