Application for a Conditional Use Permit , Richard B. <br /> 12 Freiberg, owner, Dick ' s St . Anthony "66" , 2700 Kenzie Terrace <br /> 13 C. Petition for a Setback Variance, Richard B. Freiberg, <br /> 14 owner, Dick ' s St . Anthony "66" , 2700 Kenzie Terrace <br /> 15 <br /> 16 Mr. Freiberg agreed to have these two issues heard <br /> 17 simultaneously. <br /> 18 <br /> 19 The Public Hearings were opened at 7 : 15 p.m. by Chair Faust . <br /> 20 ' <br /> 21 He read the notice of public hearings for both of these items <br /> 22 which appeared in the October 9, 1993 edition of the Bulletin . <br /> 23. <br /> 24 <br /> 25 The proposed addition of two bays in the service station <br /> 26 building requires a variance of 32 ' 6" and the proposed canopy <br /> 27 requires a variance of 23 feet . The conditional use permit is <br /> 28 required as there will be an expansion of the use of the <br /> 29 building. <br /> 30 <br /> 31 The City Manager felt this station is located on a very unique <br /> 32 site. It is small , contains two right-of-ways and is <br /> 33 triangular shaped . The setbacks normally required for this <br /> 34 type of situation would nearly render the lot unbuildable. He <br /> 35 also noted that a portion of the bowling alley building is <br /> 36 located on this parcel . <br /> 37 <br /> 38 The required parking spaces cannot be located on the property <br /> 39 line but staff is recommending a variance to 0 feet . The pumps <br /> . 40 will remain in their present location and the canopy will be <br /> 41 placed over them. <br /> . 42 <br /> 43 Commissioner Madden noted there is no canopy length on the <br /> 44 submitted drawing. The canopy will be forty-eight feet . <br /> 45 Canopies at two other service stations in the City are smaller <br /> 46 in length. <br /> 47 <br /> 48 The City Manager stated that the length can be addresssed as <br /> 49 a condition in the conditional use permit if the Planning <br /> 50 Commission' so chooses . <br />
