I have also enclosed three blueline and nine 81/2 x 11 <br /> sized site plans showing the proposed setback. I have not sent a new <br /> landscape plan since it'would change very little. A check for $230.00 is included <br /> for the Conditional Use Permit (previously submitted) and for this Petition for <br /> Variance. <br /> This variance is necessary because of a private building envelope that has been <br /> placed on the property presents an undue hardship. Essentially, no building can <br /> be constructed on the north 50% of Lot 4. 1 have enclosed portions of the <br /> "Reciprocal Easement Agreement" dated May 6, 1996 that was recorded <br /> against title for Lot 4 on May 10, 1996 that imposes this restriction. I have <br /> attached a diagram showing where the,north building envelope line is located. <br /> have asked my architect to squeeze the north - south dimension of our project <br /> as much as possible. I am told that any more reduction in this north - south <br /> dimension will hinder proper circulation. As a result, only a setback variance <br /> can solve this problem. <br /> It is important to note that this variance will not alter the character of the property <br /> and we will still relate well with the property to the south (City Liquor Store). <br /> Si erely, <br /> hn C.
