r ; <br /> Planning Commission Regular Meeting Minutes <br /> June 17, 1997 <br /> Page 2 <br /> 1 The expansion proposal includes the addition of three auto repair bays; two bays will be <br /> 2 constructed on the south side of the existing building and one will be constructed on the north <br /> 3 side. The proposed car wash facility will be attached to the proposed auto bays to the south <br /> 4 of the existing building. <br /> 5 The car wash will require a front yard setback variance because it extends 24 feet beyond the <br /> 6 front of the existing building and the two adjacent buildings. The City Ordinance requires a <br /> 7 front yard setback equal to the greater of 35 feet or a distance equal to the average of the <br /> 8 front yard depths of the two adjacent lots. <br /> 9 Exhaust Pros is situated in the City's commercial zoning district. The proposed car wash is a <br /> 10 permitted use in the Commercial District according to the City's Zoning Code, Section <br /> 11 1635.05, Permitted Conditional Uses, (f) car washes. The proposed addition of auto bays to <br /> 12 the existing building, which is considered an expansion of a permitted use, also requires a <br /> 13 conditional use permit. <br /> 14 Conditions to be considered for this permit include hours of operation, landscaping, lighting <br /> 15 and signage. Exhaust Pros has residential areas to the west and east and the above-stated <br /> 16 factors may be of concern. <br /> 17 Ms. Moore-Sykes reported Staff is recommending approval of the conditional use permits on <br /> 18 conditions stipulated by the City. <br /> 19 Ms. Moore-Sykes reported the City did receive a letter from Mr. R.W. Morgan, 3935 Silver <br /> 20 Lake Road NE, in objection to the proposed project. It was also noted that he was writing as <br /> 21 an individual and not on behalf of the townhome association. <br /> 22 Mr. Phil Rosar, owner of Exhaust Pros, asked what Mr. Morgan's objections were. <br /> 23 Ms. Moore-Sykes read, "The Exhaust Pros facility is not well maintained with very poor <br /> 24 asphalt drive area, the grass and shrubbery is not cared for and general appearance is a <br /> 25 disgrace. We were advised when Exhaust Pros opened that there would be very little noise. <br /> 26 The noise is excessive and racing of engines is extremely loud. The exhaust work is with all <br /> 27 doors open in summer and the open doors face our houses. I see no need for a car wash there <br /> 28 in the immediate area. A car wash across from our homes will give additional traffic which <br /> 29 has also been increased on that corner by the cars from CUB Foods. We, Town Homes <br /> 30 owners, recognize that changes in our ecology do happen, but to add another unnecessary <br /> 31 expansion of Exhaust Pros is objectional to all of us and our ownership valuations." <br /> 32 <br /> 33 Mr. Rosar stated the reason he was making the request for expansion was to remove the blight <br /> 34 in the area and dress it up. He was hard pressed to believe that his business was causing Mr. <br /> 35 Morgan distress. He noted the area is zoned commercial and another business could be <br /> 36 located there which would generate more traffic. The reason he had not cleaned the area up <br /> 37 sooner was that he was waiting to see if CUB Foods would locate in Apache Plaza. He stated <br /> 38 he was sorry to hear the objection because he had thought he was a good neighbor. <br />
