STAFF REPORT <br /> DATE: June 17, 1997 <br /> TO: Planning Commission Members <br /> FROM: Kim Moore-Sykes, Management Assistant <br /> ITEM: 97-03 Phil Rosar, Exhaust Pros, 4000 Silver Lake Road -- <br /> Front Yard Setback Variance Request. <br /> BACKGROUND: <br /> Mr. Phil Rosar, owner of Exhaust Pros at 4000 Silver Lake Road, is planning to expand his <br /> business at the current site to include a car wash and extra bays for auto muffler repair and <br /> oil change. The expansion proposal includes the addition of three auto repair bays; two <br /> bays will be constructed on the south side of the existing building and one will be <br /> constructed on the north side. The proposed car wash facility will be attached to the <br /> proposed auto bays to the south of the existing building. <br /> The car wash will require a front yard setback variance because it extends 25 feet beyond <br /> the front of the existing building and the two adjacent buildings. The City Ordinance <br /> requires a front yard setback equal to the greater of 35 feet or a distance equal to the <br /> average of the front yard depths on the two adjacent lots. <br /> ANALYSIS: <br /> While the proposed addition to the south side of the existing building; if constructed, will <br /> be 49 feet from the property line. The Zoning Code requires the front yard setback to be <br /> the greater of 35 feet or the average depth of the front yard setbacks of the adjacent <br /> properties. The'proposed car wash addition will extend 25 feet beyond-the front yard <br /> depths of the adjacent properties, thereby making it necessary for the variance. <br /> Adhering to the front yard setback requirement will prevent Mr. Rosar from expanding his <br /> business also precluding him from making desired improvements to this property. In its <br /> application to this property, the setback requirement may seem to excessive when <br /> considering that the proposed addition will be 49 feet from the property line. <br /> RECOMMENDATION: <br /> Staff recommends approval of the applicant's request for the 25 foot variance. The <br /> proposed addition will be 49 feet from the property line, well within the minimum 35 feet <br /> requirement of the front yard setback. Strict enforcement of this requirement may appear <br /> excessive, especially when the adjacent properties may eventually be redeveloped. <br />
