He.has <br /> 3. had contact.with the property owners at Silver Lane and Silver Lake Road on two o*ccasions and <br /> 4 feels he has achieved a degree of success. He offers offenders a solution rather than <br /> 5 recrimination. <br /> 6 Commissioner Kaczor stated he has spoken with the Fire Chief and he has stated that he is <br /> 7 promoting Clean-Up Day in the City and will deal with what remains a problem after that event. <br /> 8 Ms. Moore-Sykes noted the Fire Chief does submit a report every week on code e nforcement and <br /> 9 this can be made available to the Planning Commissioners so they can see the progress being <br /> 10 made. <br /> I I Chair Bergstrom noted that St. Louis Park collects a fee and questioned the concept of this. <br /> 12 Ms. Moore-Sykes suggested that the fee may be to cover administrative work to deal with the <br /> 13 application process. The ordinance may be more friendly to residents if they are not required to <br /> 14 pay a fee. <br /> 15 Chair Bergstrom questioned Section 1306.7, Subd.-7 of the proposed ordinance, "A buyer <br /> 16 intending to correct immediate hazards must have written consent from the City." He asked if <br /> 17 this was overly intrusive on the part of the City. <br /> 18 Ms. Moore-Sykes stated this was included so the City would have proof that the work was <br /> 19 actually completed. <br /> 20 Chair Bergstrom suggested a second inspection be required with a report submitted to the City to <br /> 21 verify that all work had been completed. <br /> 22 Commissioner Kaczor noted that an inspection can cost$300. These costs are likely to be added <br /> 23 to the price of the house. <br /> 24 Chair Bergstrom asked how the City can.stop a transaction. <br /> 25 Ms. Moore-Sykes stated the enforcement options are addressed in 1306.08, Subd. 3. Options can <br /> 26 include mandamus, injunction, or other appropriate remedy in a court of competent jurisdiction. <br /> 27 Ms. Moore-Sykes noted the ordinance will be presented to the Council at their May 5 work <br /> 28 session. She is also preparing a proposed Park Commission Ordinance to be presented at that <br /> 29 work session. <br /> 30 <br /> 31 Chair Bergstrom noted that some of the items addressed in point of sale ordinance are'also <br /> 32 addressed in the Uniform Building Code and the Fire Code and should be referenced.
