1� <br /> ANALYSIS <br /> The Nativity Church was constructed in 1958 and at approximately the same time, the sign was <br /> installed. Since the City's Ordinance was not codified until 1976, both the Church and their <br /> • <br /> identifying g si sign " randfathered in" with regard to the setback re q uirements of the <br /> Ordinance. Glenn Seefeldt, Pastor of Nativity Lutheran Church, submitted a Petition for <br /> Variance to the front yard setback requirement to allow the Church's identifying sign to continue <br /> to exist in its present location. <br /> The State Statute and the City Ordinances require that the following conditions must be satisfied <br /> for approval of this request: that the proposed variance would relieve an undue hardship; that <br /> the proposed variance would be-used to correct an extraordinary circumstance which is not <br /> applicable to another property in the vicinity or zoning district; and that the hardship was caused <br /> by the City Ordinance and granting the variance would not alter the essential character of the <br /> locality. The Church's sign has continued to exist in its present location since the Church was <br /> constructed in the late 1950's. In its present location, it has not caused nor does it cause any <br /> public safety issues for those traversing Silver Lake Road. <br />
