Mr. 4 Kalscheur answered affirmatively. 5 Hanson stated his support for hours of operation of 7:00 a.m. to 11:00 p.m. 6 Motion byBergstrom,second by Melsha,to recommend approval of a conditional use permit for the 7 construction of a 14,490 square foot Walgreens store on the corner of Silver Lake Road and 37th 8 Avenue North with a two lane drive-thru pharmacy on the north side of the building, based on the 9 finding that the use is not detrimental or injurious,the use is necessary and desirable at this location, 10 and subject to staff comments contained in its memorandum,the City Engineer's December 7 and 1 l December 19, 2000 comments, and the following conditions: 12 1. The proposed westerly entrance to the site from 37th Avenue NE be aligned with Belden 13 Drive.on the south side of 37th Avenue NE. 14 .2. . Access permits to Silver Lake Road be acquired from Ramsey County and City access permit • 15 for 37th Avenue.NE, and copies submitted to the City of St:Anthony. 16 3. The proposed site discharges directly to Silver Lake. Therefore, treatment to NURP 17 recommended standards will be.required. However,due to site restrictions,a 5:1 slope could 18 replace the 10:1 bench requirement at the normal water elevation. 19 4. The developer receiving approval of the development plan from the MPCA. 20 5. Due to existing soil contamination,the pond be lined to address any concerns of the MPCA. 21 6. The outlet from the proposed ponding area should provide skimming for floatable materials. 22 This may be accomplished by submerging the outlet pipe below the normal water elevation. 23 In regard to the proposed outlet structure, the top of casting on the manhole should be an 24 open grate set at an elevation below the overflow so as to provide an emergency outlet in the 25 case that the primary outlet is plugged or iced up during spring conditions. 26 _ 7. Lighting be consistent with City and Ramsey County lighting standards for Silver Lake Road .27 as judged by Dan Soler'and/or Jay Hartman and in coordination with lighting standards on 28 37th Avenue NE. 29 8. The hours of operation will be from 7:00 a.m. to 11:00 p.m. 30 9. Conditions listed in the letter from Dorsey & Whitney LLP of November 9, 2000, relating 31 to 20 foot utility easement along the east line of Lot 3 property line to be incorporated into 32 the conditional use permit. 33 10. All elements in design and submittals for application to be incorporated into the conditional 34 use permit. • 35 Motion carried unanimously. 36 9. NEW APPLICATIONS. 37 None.
