III. Conditional Use. <br /> The location of WTFs shall be a conditional use in commercial and industrial zoning <br /> districts. WTFs shall be neither a permitted nor conditional use in any residential zoning <br /> district within the City. Accordingly, all providers desiring to install a WTF in these <br /> districts need to submit an application to the City and obtain approvals from the City <br /> through the Planning Commission/City Council process. <br /> IV. Creation of Telecommunication Overlay District/Permitted Use. <br /> A new zoning district called "Telecommunication Overlay District" (TOD) shall be <br /> created in the City and WTFs shall be a permitted use in a TOD. Accordingly, when an <br /> applicant seeks to construct or install a WTF in a TOD, the applicant would deal only <br /> with City staff in applying for the required permits, etc. needed for the WTF, thus <br /> obviating the need for the Planning Commission/City Council approval process. The <br /> specified areas will only be on City-owned property. <br /> The Subcommittee has discussed the following property types being zoned TOD: <br /> 1. City-owned property (e.g., City Hall complex, Central Park, water tower); <br /> 2. School-owned property; <br /> 3. Areas zoned industrial (e.g., industrial park east of Hwy. 88). <br /> V. Application for WT Fs. <br /> A. In addition to an applicant's name, address, proposed site for a WTF antenna or <br /> tower, site plan, grading and landscaping plans, written permission of the property owner, and <br /> other such similar information, an application for a CUP, building or other permit relating to the <br /> installation or construction of a WTF or a tower, the applicant shall include the following: <br /> 1. A statement indicating that failure to comply with the conditions of approval <br /> shall result in the revocation of the permit and removal of the facility. <br /> 2. A statement indicating that the expenses incurred by the City to enforce the <br /> provisions of the permit shall be reimbursed by the applicant. <br /> 3. A statement which requires the applicant to utilize the procedures established by <br /> the FCC to resolve any complaints received relating to interference allegedly <br /> caused by the facility. <br /> 4. A statement indicating the applicant will cooperate in good faith and fair dealing <br /> in collocating wireless telecommunication facilities. <br /> 5. A statement indicating that the WTF shall be maintained in good and safe <br /> condition and to preserve its original appearance and concealment, disguise or <br /> 4 <br />
