City Council Regular Meeting Minutes <br /> January 28, 2003 <br /> Page 6 <br /> 1 license, and amending to change the references to "Young adults" and"minors"to "persons". He <br /> 2 said Version 2 contains the same changes as in Version 1 as well as the following changes which <br /> 3 were discussed but not approved by the Council on January 14, 2003: remove the$500 reduction <br /> 4 in a license renewal fee for a business that passes the annual compliance checks with no <br /> 5 penalties of$500 or greater, and the penalty matrix has been amended to provide that the third <br /> 6 violation for underage sales within the applicable time period results in a revocation of the <br /> 7 license. <br /> 8 <br /> 9 Councilmember Sparks asked about hours of sale. City Attorney Gilligan said the State law sets <br /> 10 forth the hours of sale which is noon on Sunday to 1:00 a.m. Monday. However,the City is <br /> 11 allowed to extend those hours from 10:00 a.m. Sunday to 1:00 a.m. Monday,but a public <br /> 12 hearing is needed to do so. <br /> 13 <br /> 14 Sparks noted page 40 (under F) should read 'wine',not 'wire'. <br /> 15 <br /> 16 Councilmember Horst asked why the limit on the number of on-sale intoxicating liquor licenses <br /> 17 issued by the City is no more than three. Councilmember Faust stated that going with the <br /> 18 minimum amount(three)would be preferable because it can always be increased, if needed. <br /> 19 <br /> 20 City Attorney Gilligan stated it would be difficult to decrease from six licenses. <br /> 21 <br /> 22 Mayor Hodson stated issuing three licenses versus six would allow more control. <br /> 23 <br /> 24 Motion by Councilmember Faust to approve the second reading(Version 2) of Ordinance 2003- <br /> 25 001,re: Liquor licensing. <br /> 26 <br /> 27 Motion carried unanitnouLIL. <br /> 28 <br /> 29 VIII. REPORTS FROM CITY MANAGER AND COUNCILMEMBERS. <br /> 30 Mr. Mornson reported that February 11, 2003, there will be ajoint meeting with the school. The <br /> 31 meeting will be held at the fire station. <br /> 32 <br /> 33 Mr. Mornson said February 18, 2003, there is a Public Facilities Open House at 5:30 p.m. He <br /> 34 noted that March 25, 2003, will be the final Open House. <br /> 35 <br /> 36 Mr. Mornson reported that the early year-end numbers for the liquor store are in and there's a <br /> 37 profit of$301,000. He said this profit will help offset some cuts anticipated from the State. <br /> 38 <br /> 39 Councilmember Horst had nothing to report. <br /> 40 <br /> 41 Councilmember Sparks said she attended the Village Fest Committee meeting. She said Central <br /> 42 Park will not be ready for Village Fest this summer so it will take place at St. Anthony Village <br /> 43 Shopping Center. She said the date set for this event is August 2, 2003. She noted there will be a <br /> 44 meeting the fourth Monday of every month to organize the event and they're looking for <br /> 45 volunteers. <br /> 46 <br />
