The petitioner is interested in adding two new refueling <br /> islands with four pumps as well as one steel canopy. Griffin Contracting has filed <br /> a conditional use permit and variance applications for the owner of the Mini Mart <br /> in December. A concept review of the plan was held at the December 16, 2003, <br /> Planning Commission meeting. <br /> Background: With the proposed plan, the petitioner has filed a variance <br /> application for the parking requirement, as their plans do not show enough <br /> parking. The City's commercial zoning code requires 10 parking spaces for the <br /> site, which is one space per 300 square feet of gross floor area, which is 2,960 <br /> square feet. The petitioner's plan shows five spots, plus two specifically <br /> designated as employee parking. City code does not specify for whom the <br /> parking spaces are designated for; they are located in the City's right of way, <br /> which is not allowed by code. The petitioner has commented there are 8 parking <br /> positions at the islands. Staff has relayed to them that would not count towards <br /> the required 10 parking spaces. Thus, the parking variance is for 5 parking <br /> spaces for walk-in customers. <br /> More notes regarding parking: according to the City code, parking spaces must <br /> be at least 9 feet by 19 feet and must be clearly marked and outlined. Currently, <br /> at the subject property, the petitioner told staff the parking spaces are not clearly <br /> marked and outlined. However, the petitioner said that would be added as well. <br /> Please note that according.to City code, parking is prohibited in the following: (a) <br /> within five feet of a side lot line; (b) within 10 feet of the front property line; and (c) <br /> within 10 feet of the rear lot line. Also, when a commercial property, such as this, <br /> abuts residential areas, it is unlawful to park a vehicle or provide a parking space <br />
