-3- <br /> Commenting on the thoughts expressed by Mr. Sopcinski after the <br /> Danelski decision had been made, the Mayor said she had based her <br /> • approval of the proposal .on the fact that the City Attorney had <br /> advised this approval could be considered. on a one time basis and <br /> would not necessarily dictate the kind of decision which may be made <br /> for a similar request in the future, .but she did not perceive the <br /> differences in heat-saving costs projected by the applicant at <br /> separate hearings , -and appreciated .Mr. Sopcinski ' s comments after <br /> the fact•.• She is most appreciative - of the astute comments the Plan- <br /> ning_ Commission. member provides regarding the proposals which come <br /> before the Commission. - <br /> Mr. Hamer reported .communication with .the Advisory Committee to the <br /> Health Board which indicated Dr.Carr and Mrs.. Connelly are still <br /> urging the housing maintenance code be .applied to duplexes and <br /> double bungalows. He also reported suggestions regarding the pro- <br /> posed ordinance offered by Mr. Kleinman, manager for the Diamond 8 <br /> apartments , regarding the role agents .-and managers of apartment <br /> complexesrelating to responsibility for ordinance conformance - and <br /> process servicing for violations . The City Attorney said the ordin- <br /> ance is written to place the ultimate responsibility for the main- <br /> tenance of the building to the owners who .have to be identified by <br /> name and address before- a license is granted. <br /> The discussion was deferred- until after the public hearing on the <br /> Community Development Block Grant program which was .opened by the <br /> Mayor at 8 :05 P.M. <br /> • Mr. Berg reported Resolution 817054 allows him to- reallocate funds <br /> for the Walbon Redevelopment Study ..out. of administrative costs for <br /> Year III and will verify whether the funds to be involved are <br /> $825.16 or $826. 16 . <br /> There was no one else present to offer input and the hearing was <br /> closed at 8 : 09 P.M. <br /> Motion by Cbuncilman. Ranallo and seconded by Councilman Marks to <br /> adopt Resolution-i..,.81-054 -after -the-,amount of funds to be reallocated <br /> from the CDBG program have been verified by staff. <br /> RESOLUTION 81-054 <br /> A RESOLUTION REALLOCATING CDBG MONIES <br /> Motion carried unanimously. <br /> The discussion of the housing maintenance. ordinance was resumed with <br /> suggestions from Council for. ch_anges in wording to make the require- <br /> ments easier to enforce.. Mr. Soth will research whether a distinc- <br /> tion, as -related to health, welfare and safety, can be made between <br /> two or more unit .dwellings which are owner occupied or completely <br /> rental. The penalties for failure to comply. with the ordinance were <br /> explored fully with the Attorney advising that if a license is with- <br /> drawn a penalty can be imposed for operating without that license. <br /> Councilman ' Sundland commented..that, although it might .be helpful to <br /> have the ordinance written for . all. dwellings- in the City , as the <br /> housing stock . gets older it may also become administratively difficult <br />
