-3- Commenting on the thoughts expressed by Mr. Sopcinski after the Danelski decision had been made, the Mayor said she had based her • approval of the proposal .on the fact that the City Attorney had advised this approval could be considered. on a one time basis and would not necessarily dictate the kind of decision which may be made for a similar request in the future, .but she did not perceive the differences in heat-saving costs projected by the applicant at separate hearings , -and appreciated .Mr. Sopcinski ' s comments after the fact•.• She is most appreciative - of the astute comments the Plan- ning_ Commission. member provides regarding the proposals which come before the Commission. - Mr. Hamer reported .communication with .the Advisory Committee to the Health Board which indicated Dr.Carr and Mrs.. Connelly are still urging the housing maintenance code be .applied to duplexes and double bungalows. He also reported suggestions regarding the pro- posed ordinance offered by Mr. Kleinman, manager for the Diamond 8 apartments , regarding the role agents .-and managers of apartment complexesrelating to responsibility for ordinance conformance - and process servicing for violations . The City Attorney said the ordin- ance is written to place the ultimate responsibility for the main- tenance of the building to the owners who .have to be identified by name and address before- a license is granted. The discussion was deferred- until after the public hearing on the Community Development Block Grant program which was .opened by the Mayor at 8 :05 P.M. • Mr. Berg reported Resolution 817054 allows him to- reallocate funds for the Walbon Redevelopment Study ..out. of administrative costs for Year III and will verify whether the funds to be involved are $825.16 or $826. 16 . There was no one else present to offer input and the hearing was closed at 8 : 09 P.M. Motion by Cbuncilman. Ranallo and seconded by Councilman Marks to adopt Resolution-i..,.81-054 -after -the-,amount of funds to be reallocated from the CDBG program have been verified by staff. RESOLUTION 81-054 A RESOLUTION REALLOCATING CDBG MONIES Motion carried unanimously. The discussion of the housing maintenance. ordinance was resumed with suggestions from Council for. ch_anges in wording to make the require- ments easier to enforce.. Mr. Soth will research whether a distinc- tion, as -related to health, welfare and safety, can be made between two or more unit .dwellings which are owner occupied or completely rental. The penalties for failure to comply. with the ordinance were explored fully with the Attorney advising that if a license is with- drawn a penalty can be imposed for operating without that license. Councilman ' Sundland commented..that, although it might .be helpful to have the ordinance written for . all. dwellings- in the City , as the housing stock . gets older it may also become administratively difficult
