The May liquor sales and .the Fire Department reports <br /> were then accepted as informational- as.. was .the April Police Department <br /> report following a- discussion of the number' and type- of police calls <br /> reported and a progress report on, the new Crime Watch program by the <br /> Manager. <br /> The June 3rd memorandum from. the. Public. Works Director in which he <br /> recommended the .branch pickup .program be discontinued in 1983 because <br /> of the cost and time involved, was discussed .at .great length but <br /> action deferred until after the public hearings scheduled for that <br /> time had been held. <br /> At 8: 10 P.M..,. the Mayor opened the public hearing on the proposed <br /> ordinance. amendment to allow body tanning salons as conditionally <br /> permitted uses in the City which- had been deferred .until after the <br /> notice of the hearing had been published as required. Consideration <br /> was given to both the .ordinance..amendment and the application by Keith <br /> Grewe. for- .a Conditional Use Permit under the .ordinance .amendment for <br /> the body tanning salon .he had .proposed .at .several previous hearings <br /> to be .opened in the lower level of the Apache Plaza Shopping Center <br /> as soon as he .gets the go-ahead from the City. <br /> Ordinance 1982-005 was. given its second reading- and Councilman Ranallo <br /> indicated he would vote against the ordinance amendment- because he <br /> perceives including. this type .of operation as an approved use for the <br /> City might, in his opinion, "open the door to undesirable businesses <br /> such as saunas and massage parlors" .. He indicated .to Mr. Grewe that <br /> even a visit to the St. Loui.s .Park Tan- Me salon: had not changed his <br /> • mind. The applicant responded that he could not see how there could <br /> be anything . in the manner in which other -Tan Me salons are operated <br /> which. could be a basis for the misconceptions he perceives had held <br /> up his request approval since April. . Mr.- Grewe assured the Council- <br /> man he intends to operate only a legitimate business, in St. Anthony <br /> and insisted, the very fact that numerous Tan Me salons are being <br /> established with no -problems related, to -approval , throughout the <br /> metropolitan area, .should be an .indication :that only legitimate <br /> services.. are being offered by these franchise owners . Further sub- <br /> stantiation of this fact, Mr. Grewe- believes , is the fact that the <br /> Highland Park salon is run by a-.district .judge ' s wife. <br /> Councilman Marks believes , since -.there has been. absolutely no testi- <br /> mony offered- during any previous hearings on this .proposal that this <br /> is anything but a legitimate business , "there could be no way the <br /> Council could keep a legitimate- business from operating in the City" . <br /> Councilman Enrooth agreed the' lack of negative testimony left the City <br /> with "no .recourse other than to accept the tanning salon- as a legiti- <br /> mate use under the City Ordinance" . <br /> The Mayor-indicated .he would propose the permit approval be made <br /> subject to "no violation of any. law or ordinance taking place in the <br /> salon" , which he believes would give the City the. latitude of enforc- <br /> ing any future laws which might be. passed. by .any government agency , <br /> • such as the FDA, which perceives a. possible hazard .to health or safety <br /> of the clients of such an operation. <br /> No . one other than Mr. Grewe appeared to speak for or against the amend- <br /> ment and. the Mayor closed the hearing at 8 :29 P.M. <br />
