-12- <br /> Motion by Councilman .Marks and seconded by Councilman Letourneau to <br /> waive the second reading, approve,-.the third,. and. adopt Ordinance <br /> 1982-0.09 and to authorize only the summary of the ordinance be <br /> published. <br /> ORDINANCE 1982-009 <br /> AN' ORDINANCE, INCLUDING ADDENDUM WITH EXHIBITS , GRANTING A <br /> FRANCHISE . TO- GROUP .W CABLE OF THE NORTH SUBURBS , INC. , A <br /> MINNESOTA CORPORATION, TO OPERATE AND MAINTAIN A CABLE COM- <br /> MUNICATION SYSTEM IN THE CITY; SETTING' FORTH CONDITIONS <br /> ACCOMPANYING THE GRANT OF FRANCHISE.; PROVIDING. FOR THE REGULATION, <br /> AND USE OF THE SYSTEM; AND PRESCRIBING PENALTIES FOR VIOLATION <br /> OF ITS PROVISIONS <br /> Motion carried unanimously. <br /> Mr. Soth read .the` ordinance, he had prepared at. Council direction to <br /> limit the number of amusement devices at their existing level in the <br /> City. It was the Council consensus .that since there were at that <br /> date 116 such- mach-ines in the City and Mr.. Springfield had applied <br /> for six additional machines for Chick 's , the number of devices <br /> should- be frozen at 125. <br /> Mr. Gehan indicated that this was "the first good thing he had heard <br /> all evening" . Councilman Enrooth, indicated he -believes putting a cap <br /> on the number- of devices permitted in the City would not be out of <br /> line when the. City Attorney told Councilman .Marks the residents could <br /> sue the City to enforce its ordinances if somehow one or more licenses <br /> • than permitted were issued,. Councilman Enrooth said the responsibility <br /> for keeping track of the numbers should rest with the staff. <br /> Motion- by Councilman Enrooth and. seconded. .by Councilman Letourneau <br /> to approve the' first reading .of the ordinance limiting the number of <br /> amusement devices in the City. Since the second beer license ord- <br /> inance, 1982-010 , had failed,. that number was retained for this <br /> ordinance. <br /> ORDINANCE 1982-010 <br /> AN ORDINANCE .LIMITING THE .NUMBER OF LICENSES <br /> FOR AMUSEMENT DEVICES; AMENDING CHAPTER IV OF <br /> THE 1973 CODE OF ORDINANCES BY ADDING A SECTION <br /> Motion carried -unanimously. <br /> Motion- by Councilman Ranallo .and seconded by Councilman Enrooth to <br /> adjourn the meeting at 10 : 05 P .M. <br /> Motion carried unanimously . <br /> - Respectfully submitted, <br /> Hc1len Crowe , Secretary <br /> Mayor <br /> ATTEST: <br /> Ci y Clerk <br />
