-2- <br /> proposals . His . eval,uation would be structured in such a manner, he . <br /> C • said, as to stimulate other .questions .for the City officials to ask <br /> of the developers . Mr. Krier. suggested the format. of the interviews <br /> he distributed should be followed as closely as possible so the inter- <br /> views would be perceived to be fair by the developers. The consultant <br /> said his experience with developers has been that they want interviews <br /> held as close together as possible and conducted in as formal manner <br /> as possible for fairness . For this reason, Mr.. Krier. indicated he <br /> believes it- to be essential. that only the H.R.A. .members. be permitted <br /> to participate in the questioning, with . the Attorney permitted. to <br /> clarify any legal questions. He also recommended the proceedings be <br /> taped and recorded to avoid any misunderstandings later. <br /> When asked at what point public input to the planning would be sought, <br /> the consultant indicated that on February. 22nd .the H.R.A. would appoint <br /> a tentative developer and accept a general plan for :the project, by <br /> resolution, after which there would be 90 days in which the plans could <br /> be .fine=tuned before an agreement with the developeris signed and it <br /> would be in this. interim that the H.R-.A. could seek the advice and <br /> input of the public and other participants in the- planning process . <br /> Mr. Soth entered the meeting during this discussion and,' when Mr. <br /> Krier suggested the meeting scheduled for 5.:00 . P.M. , February lith, <br /> where the H.R.A. would discuss the proposals , should be closed to the <br /> public, gave his thoughts on that proposal. He said up until a recent <br /> meeting of city attorneys , he had..believed such meetings -should be <br /> open, . but information he received at that time raised the question in <br /> C • his own mind whether the violation of . rights of privacy would not be <br /> involved as well as the open meeting laws .if the public were permitted <br /> to attend the meeting where confidential .economic information provided <br /> by the firms would be discussed. He said he would. research the matter <br /> further. The attorney added that -other persons have no legal right <br /> to speak during interviews which are by nature , public hearings , not <br /> debates . <br /> Mr. Soth also .advised that it be made .clear that the selection of a <br /> developer is only tentative in order that claims against the City later <br /> would be negated in- the event the negotiations which follow selection <br /> fail to produce a viable project. <br /> Motion by Councilman Ranallo and seconded by Councilman Marks to' adjourn <br /> the special work session at 7 : 45 P.M. <br /> Motion carried unanimously. <br /> Respectfully submitted, <br /> Helen Crowe,, Secretary <br />
