•
CITY OF ST. ANTHONY
EXECUTIVE SESSION MINUTES
May 14, 1985
The executive session with City Attorney William Soth was called at 8:46 P.M.
by Mayor Sundland..
Present for roll call : Marks, Ranallo, Sundland, Enrooth, and Makowske.
Also present: City Manager David Childs and Mr. Soth.
As he advised the Council during the closed executive session April 9th, the
Attorney reiterated that, because of the remote possibility of a connection Dorsey
& Whitney might have with one of the firms involved in the litigation related to
the City' s water contamination problems, Becky Comstock of the :Dorsey firm, (who
had been doing the preliminary research necessary to keep the Council informed as
to actions St. Anthony might need to take related to that litigation) , had been
looking for another law firm to perform the same service for the City. Mr. Soth
said it was Ms. Comstock's recommendation that the City retain the law firm of
Briggs & Morgan, who also had some expertise in environmental litigations, to
• take the next legal steps necessary to get the City included in that litigation.
The City Attorney indicated he would get an estimate of their charges from Briggs
& Morgan, informing them at the same time of the agreement which Dorsey & Whitney
had with St. Anthony for the same services.
Motion by Councilman Rana•llo and seconded by Councilman Makowske to authorize- the
City Attorney and City Manager to retain Briggs & Morgan to get the City included
in New Brighton's suit .against the parties alleged to •be responsible for that
city's and St. Anthony's water.:contamination problems.
Motion carried unanimously.
Motion by Councilman Marks and seconded by Councilman Ranallo to adjourn the
executive session at 9.:00 P.M.
Motion carried unanimously.
Respectfully submitted,
Helen Crowe, Secretary
Mayor
ATTEST:
City Manager
