CITY OF ST. ANTHONY <br /> COUNCIL EXECUTIVE SESSION MINUTES <br /> August 12, 1986 <br /> The Council 's Executive Session to consider Briggs and Morgan's recommendation related <br /> . -to the next steps to be taken in regard to the City' s water contamination suit . <br /> against the U.S. Army et al was opened at 8:26 P.M. following the recess of the <br /> regularly scheduled meeting at 8:25 P.M. <br /> Present: Ranallo, Marks, Enrooth, and Makowske. <br /> Absent: Sundland. <br /> Also present: David. Chil-ds, City Manager; David McDonald 'of Briggs and Morgan; and, <br /> Bruce Liesch and Ken Olson of Bruce Liesch Associates. <br /> Mr. McDonald introduced Mr. Liesch; a .geologist, and Mr. Olson, a hydrogeologist, to <br /> the Councilmembers, indicating he was recommending the City retain the firm to <br /> research all the materials in the 15 file drawers the MPCA has related to the <br /> contamination at the Twin Cities Army Ammunition Plant to make a connection between <br /> the contamination present in New Brighton and St.. Anthony wells, particularly the <br /> connection between the two cities. The attorney indicated he perceived the data <br /> which the consulting firm gathered would not only be helpful to the City's case <br /> against the parties responsible for the water contamination, but would also provide <br /> verification of information other government agencies might cite to support their , <br /> own conclusions about the source of the contamination. <br /> • Mr. McDonald then indicated Briggs and Morgan would like to also use the data the <br /> Liesch firm gathered to support the law suits the firm had al.so instigated for <br /> private property owners who believed they had also suffered contamination from the <br /> arsenal and suggested the costs of the study be split evenly between Briggs and <br /> Morgan and St. Anthony. <br /> The consultants answered questions about their proposal to make the study and their <br /> past experience with Superfund contaminations. Mr. Childs said he would be very <br /> comfortable with using them as expert witnesses after they had completed the study <br /> they proposed. <br /> Mr. McDonald indicated he perceived that even if the lawsuit were not continued, the <br /> firm's expertise and the study they had made would be most valuable towards the <br /> development of a settlement which would be good for the City. <br /> The Executive Session was recessed at 8:45 P.M. to reconvene the regular Council <br /> meeting for a motion to approve retention of the Liesch firm and when reconvened at <br /> 8:50 P..M. to make preparations for a St. :Anthony presence at the MPCA meeting August <br /> 26th and to plan the tour of MPCA Board members through St.Anthony and New Brighton <br /> before their tour and lunch at the arms plant, August 21st. <br /> The work session was recessed again at 9:28 P.M. following the departure of the <br /> attorney and Mr. Liesch and Mr. Olson and when reconvened, considered the Manager's <br /> recommendation related to changes in the City' s Personnel Ordinance. <br /> The Manager and Council discussed his memo of August 8th regarding proposed changes <br /> • in the Personnel Ordinance. The Manager was directed to prepare the proposed (recom- <br /> mended) changes in ordinance form for further consideration and ultimate decision <br /> making at a future Council meeting. <br /> The meetin adjourned 0:19 P.M. <br /> ATTEST: <br /> City Clerk Mayor <br />
