• 1 =5- <br /> 2 told Councilmember Makowske he did not believe the fact <br /> 3 that the neighbors might want to buy the land to keep it <br /> 4 from being developed would justify further tabling of <br /> 5 action on the proposal; but <br /> 6 advised that an exception to the Supreme Court ruling <br /> 7 would be that, if the property owner owned the adjoin- <br /> 8 ing lot, the City would not be required to grant these <br /> 9 variances; <br /> 10 added that Council' s approval that evening would cer- <br /> 11 tainly not preclude the neighbors' negotiating such a <br /> 12 purchase later on, but the above would be true of that <br /> 13 ownership as well; <br /> 14 reiterated his belief that, with their June 22nd letter, <br /> 15 the attorneys for the deceased property owner "had <br /> 16 joined in the variance application" ; <br /> 17 recommended the Council take action on the variance <br /> 18 requests that evening. <br /> 19 Proponent: William Campbell, of Campbell Construction Inc. , 12409 <br /> 20 Drake Street N.W. , Coon Rapids, MN. <br /> • <br /> 21 indicated he opposed any further delays on his request; <br /> 22 questioned whether the fact that the "neighbors might <br /> 23 give me trouble" was a viable reason for denying the <br /> 24 variances;. <br /> 25 replied to the question of whether he was going to live <br /> 26 in the house he proposed to construct by saying "that <br /> 27 depends on the neighbors. " <br /> 28 Jake Cadwallader of Cadwallader Realty, 3901 Silver Lake <br /> 29 Road, was present but did not speak. <br /> 30 The neighbors ' opposition to a house being built on that small lot was <br /> 31 again stated by Kenneth Hoxmeier, 3657 Roosevelt who: <br /> 32 -drew the Council' s attention to the copy of the petition against <br /> 33 the City' s allowing a house on this lot which had been included <br /> 34 in their agenda packet; <br /> 35 -reiterated the concerns he and his neighbors shared related to <br /> 36 problems with drainage, snow storage, and sight distance ob- <br /> 37 struction for drivers ' on Roosevelt if a house is built on this <br /> 38 lot; <br /> 09 -pointed out that in some instances the City was being asked to <br /> 40 grant variances which were 50% more than the Ordinance allowed; <br />
