1 -7- <br /> 2 residences, which would allow a home to be constructed on the 5,648 <br /> 3 square foot lot on the southeast corner of 37th Avenue and Roosevelt <br /> 4 Street N.E. and a setback variance to the Ordinance requirement for 30 <br /> 5 foot setbacks on corners which would allow a reduced size house to be <br /> 6 constructed 16 feet from the 37th Avenue property line. The Council <br /> 7 further agrees with the Planning Commission that the following <br /> 8 conditions be imposed on the granting of these variances: <br /> 9 1 . that, in response to the neighbors' concerns about drainage, <br /> 10 a 20 foot drainage easement be maintained on the east side <br /> 11 of the property; <br /> 12 2. that- the easement papers and information on the title be <br /> 13 submitted for the City Attorney' s review; <br /> 14 3 . that no vegetation higher than 3-1/2 feet be planted along <br /> 15 37th Avenue from Roosevelt Street to the eastern edge of <br /> 16 the house; and <br /> 17 4. that no curb cut off 37th Avenue N.E. be allowed. <br /> 18 In granting these variances, the Council finds, as did the Planning <br /> 19 Commission, that: <br /> 00 *other uses of the lot seem to be limited; <br /> 21 *the extent of the variance request presented at this time differs <br /> 22 greatly from the variances for a duplex which were denied in <br /> 23 1979; <br /> 24 *all three conditions required by statute to be satisfied affirma- <br /> 25 tively before these variances can be granted have been satis- <br /> 26 factorily addressed"by_:the applicant " in his-.petition. <br /> 27 Motion carried unanimously. <br /> 28 <br /> 29 Commissioner Wingard was thanked for his report. He remained for the <br /> 30 discussion of damage to basements, which had resulted from the inability <br /> 31 of the City' s storm and sanitary sewer systems to handle the 9 inch <br /> 32 rainfall which fell in a short time during the storm the metropolitan <br /> 33 area had experienced the evening of July 23 , 1987 . <br /> 34 Residents ' Complaints Are Heard <br /> 35 Allen and Cris Kremer, 2829 Coolidge reported they had installed a <br /> 36 waterproofing system on their home which "had worked beautifully." during <br /> 37 the storm, but had sewage backing up into their basement and ruining <br /> 38 that newly decorated area. Mr. Kremer reported his wife had canvassed <br /> 39 the four blocks around their home and found 21 of the 30 homeowners <br /> 0 whose names appeared on the listing the Kremers presented, had <br /> 1 experienced sewage backup into their basements.
