1 to question why the City doesn' t close the establishment down. <br /> 2 Councilmember Ranallo said it was his own personal opinion that to <br /> 3 put another amusement arcade in this location, would only result in <br /> 4 "lowering the class in St. Anthony. " He also indicated he was <br /> 5 "really surprised that the Apache management wanted to put a <br /> 6 loitering place for children in their center where they have <br /> 7 beautiful stores like Herberger ' s and Penneys. " <br /> 8 Attorney Advises City Doesn' t Have to Grant Each and Every Request <br /> 9 for a Conditional Use Permit <br /> 10 Cavanaugh said it was his understanding that amusement arcades are <br /> it permitted conditional uses which had to be granted but which could <br /> 12 have some restrictions put on them; <br /> 13 therefore, he perceived the Council was not able to keep the arcade <br /> 14 from coming into his shopping center. <br /> 15 Soth told him that was not completely true; <br /> 16 said although amusement arcades are a use permitted only by a <br /> 17 conditional use permit, the Council has some discretion in granting <br /> 18 conditional use permits. In other words, it' s possible to deny a <br /> 19 conditional use permit because there' s nothing to say each and every <br /> 20 request for a conditional use permit has to be granted; <br /> 021 added that if granting such a permit were automatic, there would be <br /> 22 nothing to discuss that evening, except the conditions. <br /> 23 Cavanaugh indicated there had been other requests made for similar <br /> 24 operations in Apache which he had turned down, but accepted Dan <br /> 25 Heilicher' s proposition because the Apache management knew it was a <br /> 26 high quality type of operation held in high regard and would not be a <br /> 27 detriment to Apache Plaza; <br /> 28 indicated he perceived the Commission had been mostly concerned about <br /> 29 the arcade' s proximity to a bar; <br /> 30 pointed out that in 1983 and 1984 a game room in which food had been <br /> 31 sold had been operated 150 feet away from the liquor lounge in Apache <br /> 32 and they had virtually no problems with that; <br /> 33 in regard to the security, indicated that in addition to the security <br /> 34 Mr. Heilicher would be providing, Apache has 24 hour security; <br /> 35 reported that typically, every hour, on the hour the security goes <br /> 36 outside and cruises the parking lot and "if they see anybody <br /> 37 loitering outside any store, they break up the congregation. " ; <br /> 38 told the Council he was requesting the arcade be allowed to stay <br /> �39 open Saturday and Sunday nights until 9: 00 P.M. <br /> 8 <br />
