1 REGULAR COUNCIL MEETING <br /> AUGUST 25, 1992 <br /> PAGE 14 <br /> 4 <br /> 5 <br /> 6 <br /> 7 The City Attorney advised he substantially re-wrote the <br /> 8 ordinance by changing the wording but not the substance. He <br /> 9 noted that he has replaced the word "utility" with the word <br /> 10 "facility. " <br /> 11 <br /> 12 Dennis Cavanaugh, a St . Anthony resident , had submitted a list <br /> 13 of written questions regarding this ordinance at a previous <br /> 14 Council Meeting. He thanked the City Attorney for his <br /> 15 responses and for the additional information he received from <br /> 16 t-he City Manager. <br /> 17 <br /> 18 Mr. Cavanaugh still feels the ordinance should be tabled. He <br /> 19 observed that the Task Force has recommended that sidewalks be <br /> 20 included in the usages for these funds also. He is of the <br /> 21 opinion that "utility" is not well defined and he has observed <br /> 22 that it appears that the funds generated the first year will <br /> 23 be used for a plan . <br /> 24 <br /> 25 The Mayor is supportive of the fund and noted that there will <br /> 26 be federal mandates coming in the near future which will <br /> 27 require cities to clean up their storm water. He felt there <br /> are two ways to do this ; set up the fund so it cannot be <br /> is tampered with by the Legislature or wait -until the clean up is <br /> 30 mandated and then find ways to pay for this . <br /> 31 <br /> 32 Another resident stated he feels the City Council should be <br /> 33 looking for solutions to the water problems now. He cited an <br /> 34 instance where his son hit a sink hole with his car and the <br /> 35 car was significantly damaged. <br /> 36 <br /> 37 Motion by Enrooth, second by Wagner to approve the second <br /> 38 reading of Ordinance No. 1992-007 , being an ordinance <br /> 39 relating to the construction, reconstruction, repair and <br /> 40 improvement of storm sewer systems and related facilities and <br /> 41 charges for the use and availability of storm . water <br /> 42 facilities ; amending the St . Anthony 1973 Code of Ordinances <br /> 43 by adding a new Section 260 . <br /> 44 <br /> 45 Councilmember Marks stated he favors a dedicated fund to do a <br /> 46 dedicated job. He requested a preliminary plan listing items, <br /> 47 costs and schedule. <br /> 48 <br /> 49 The City Manager advised he and the City staff have just <br /> 50 started working on a . five year capital improvement plan .
