Bauer wishes to refinance one side of the <br /> 9 building and the land and split it into two separate parcels <br /> 10 for ownership. <br /> 11 <br /> 12 The City can subdivide the property using the same survey and <br /> 13 parcels A and B division line as the new property line. <br /> 14 <br /> 15 Subdivision can be done waiving the replat requirements . As <br /> 16 this is an existing structure, a lotsplit requires a zero lot <br /> 17 line which requires a variance. <br /> 18 <br /> 19 There also needs to be a variance for lot area, width and lot- <br /> 20 coverage. The zero lot line variance would be for five feet <br /> 21 for each structure. The other three variances are required as <br /> 22 the current lot meets the ordinance, but the two proposed lots <br /> 23 would not . <br /> 24 <br /> 25 The City Manager advised there are some other zero lot line <br /> 26 situations on 37th Avenue between Stinson Boulevard and Silver <br /> 0 Lake Road. <br /> 29 These buildings were built intentionally to be zero lot line <br /> 30 situations and the lots are considerably larger than this one . <br /> 31 When the Bauer building was constructed the zero lot line <br /> 32 concept did not exist . <br /> 33 <br /> 34 Councilmember Wagner expressed concern regarding exterior <br /> 35 maintenance if each side of the bungalow is owned by different <br /> 36 parties . <br /> 37 <br /> 38 The City Manager stated that a "party wall agreement" can be <br /> 39 filed with the plat . This agreement will not address <br /> 40 landscaping nor snow removal but will address all other <br /> 41 "common" aspects of the building. <br /> 42 <br /> 43 Councilmember Enrooth was not confortable with this procedure . <br /> 44 The City Manager stated he will have the matter reviewed by <br /> 45 the City Attorney. <br /> 46 <br /> 47 Motion by Wagner, second by Marks to approve the subdivision <br /> 48 request (waiving plat requirements ) and the variances be <br /> 49 granted with the following hardship: <br /> 50 <br /> • <br />
