(following close of polls for the school referendum) or on April 25, <br /> 27 1994 at 7:00 P.M., depending upon the mutual availability of Mr. Brimeyer and <br /> 28 the City Councilmembers. <br /> 29 B. Darrin and JoAnn Mercil had previously sought and were granted a front and rear yard <br /> 30 variance to building a house at 3112 Silver Lake Road. The property survey was done <br /> 31 after the variance was approved and the Mercil's discovered the back of their proposed <br /> 32 home would be very close to the neighbor's house to the south. Also present was the <br /> 33 builder, Larry Beach. Mr. Beach and Mr. Mercil indicated that if the home were <br /> 34 constructed according to the first variance, the house would be set too far back and <br /> 35 they requested permission to proceed with the construction of the home, lining it up <br /> 36 with the existing homes and protruding the garage out an additional 8 feet. They are <br /> 37 speaking to the Council tonight because the Planning Commission does not meet until <br /> 38 April and waiting a month would put the entire project in peril. <br /> 39 Mayor Ranallo informed Mr. Mercil and Mr. Beach that they will need to go through <br /> the variance process again. When contacted, the City Attorney agreed that the law is <br /> it clear on this matter. Mr. Mercil said he had contacted the property's immediate <br /> 42 neighbors who all indicated their approval of the newest plans. Mr. Mercil was told by <br />
