City Council Regular Meeting Minutes <br /> • January 10, 1995 <br /> Page 10 <br /> 1 Ranallo asked if this would be setting a precedent. <br /> 2 Soth stated it was not. The same thing can be done with the next project. If after calculating the <br /> 3 assessments, there is a specific case that does not seem fair and related to the benefit, it can be <br /> 4 changed. <br /> 5 Motion by Wagner, second by Ranallo to approve Resolution 95-012, ordering improvements to <br /> 6 Crestview Drive, from 29th Avenue N.E. to 31 st Avenue N.E.; Armour Terrace, from Silver <br /> 7 Lake Road to Crestview Drive; Bell Lane, from Armour Terrace to Crestview Drive; and East <br /> 8 Gate Road, from Crestview Drive to Rankin Road. <br /> 9 Motion carried unanimously. <br /> 10 Motion by Marks, second by Fleming to approve Resolution 95-013 adopting and confirming <br /> 11 1995 street improvement assessments and placing a cap of$3,500.00 similar in respect to the <br /> 12 cul-de-sac. <br /> 13 Wagner expressed his concern that there were many more corner lots in the village compared to <br /> 14 the amount of cul-de-sacs. <br /> • <br /> 15 Enrooth added that the cap needed to be able to fluctuate in any given year. <br /> 16 Ranallo stated that the fees could not be moved to the other taxpayers in the city. <br /> 17 Enrooth stated there was no perfect system in regards to assessments. The appeal process was <br /> 18 still an option for residents. He felt the adjustment on the cul-de-sac was legitimate but there did <br /> 19 not seem to be basis for adjusting the fees on the comer lots. <br /> 20 Voting on the motion: <br /> 21 <br /> 22 Aye: Marks and Fleming <br /> 23 Nay: Ranallo, Enrooth, Wagner <br /> 24 Motion failed. <br /> 25 Motion by Wagner, second by Enrooth to approve Resolution 95-013 adopting and confirming <br /> 26 assessments for various public improvements. <br /> 27 Voting on the motion: <br /> Aye: Enrooth, Wagner, Ranallo, Fleming <br /> 9 Nay: Marks <br />
