There are no windows or doors on the north side <br /> 2 of the neighboring home. Bergstrom reported that after extensive discussion deliberating <br /> 3 if this was a buildable lot,the Planning Commission recommended approval of the front <br /> 4 yard variance of fifteen feet; the ordinance requires 30 feet, backyard variance of twelve <br /> 5 feet; the ordinance requires 25 feet, and the lot area variance of 440 square feet; the <br /> 6 ordinance requires 11,000 square feet, for 3111 Silver Lake Road, on the basis the <br /> 7 diagram and footprint presented by Mr. Beach be followed as he presented it here, as <br /> 8 there is an undue hardship due to the physical surrounding shape, topography, and <br /> 9 conditions of the parcel, the proposed variance is based not exclusively on the desire to <br /> 10 increase the value-or the income of the potential parcel but would correct extraordinary <br /> 11 circumstances that apply to other properties in the vicinity or zoning district, the <br /> 12 difficulty in this hardship is due to City Ordinance, in regards to public safety this would <br /> 13 represent the best use of the property placement of the house versus placing it on Silver <br /> 14 Lake Road, verification of the survey of the parcel, drainage issue of the property <br /> 15 addressed by the City Engineer, and the property cleared of any remaining non- <br /> 16 conforming structures. Bergstrom reported two people, Larry Beach and Darrin Mercil <br /> 17 spoke for the proposal and two people, Carinna Moncada and Greg Cartalucca, spoke <br /> 18 against the proposal. Bergstrom indicated their was not yet a client willing to build the <br /> _9 house in the drawing. He stated Mr. Beach was trying to do a build to suit. Bergstrom <br /> explained Mr. Beach's assertion was that without guidelines from the Planning <br /> 21 Commission and City Council in regards to what can be built on the property, he may <br /> 22 have a difficult time finding a buyer. <br /> 23 Enroothh-indicated he was most concerned with the variance on the southeast corner <br /> 24 against the Moncada property. He asked if the house could be placed further east so it <br /> 25 would require a smaller variance. <br /> 26 Mr. Larry Beach, Larry Beach Construction, explained that Mrs. Moncada did not want <br /> 27 the house moved further east as it would encroach more upon Mrs. Moncada's property <br /> 28 and more windows would be facing her property. He explained he had placed the house <br /> 29 toward Silver Lake Road to create more side yard and the garage on Silver Lake Road to <br /> 30 buffer the street noise. Mr. Beach stated the 2nd story windows of the proposed structure <br /> 31 would face Mrs. Moncada's gable wall which has no windows. <br /> 32 Mrs. Carinna Moncada, 3107 Silver Lake Road, questioned why a 38 foot wide house <br /> 33 was being placed on a lot size that only accommodates a 25 foot wide house. <br /> 34 Mr. Beach indicated this was necessary to achieve the necessary square footage. He <br /> 35 indicated he had removed the bay windows which were proposed on the house and <br /> 36 replaced them with kitchen cabinets, so the bay would not be facing her house. <br />
