It is the intention of the parties that this <br /> contract shall be amended, when 0 and M costs are finalized at the conclusion of the <br /> construction phase, to provide 90 percent 0 and IM cost reimbursement to the City from <br /> the State through the State's NBCA with EPA for the shakedo;%n year. Prior to the end <br /> of the shakedown year, the City shall prepare and, subject to EPA approval thereof, <br /> administer a separate cooperative agre°zrnnt with EPA which addresses the last nine <br /> years of the Extended RA; and <br /> WHEREAS, an 0 and M budget has been prepared by the State's Consultant Engineer for <br /> the first year of the Extended RA; and <br /> WHEREAS, the City and the State have agreed to the budget as proposed; and <br /> WHEREAS, the City has requested that a standby generator h° included as part of the <br /> Remedial Action project. This standby generator would L-� us_-J in emergencies to <br /> provide electricity to the high service pumps to enable the City to provide water <br /> durijig turps of electrical outages; and <br /> MiEREAS, the State and the EPA have reviewed this request and have agreed that a <br /> standby generator is an acceptable purchase as part of the Renpdial Action project; and <br /> • <br />
