The City <br /> 8 Attorney advised that jet skis cannot be banned as this lake <br /> 9 is viewed as public water and the- State owns the surface-water <br />_ 10 _ :_a c c or-d-i-n g--t o S-t a-t a--S-t a-t-u-t-e- <br /> 12 A resident st.ated' that ."j_et- skis can b.e- restricted by the age- <br /> 13 of their users and closeness to property . He noted that there <br /> 14 can be no restrictions on not-se nor speed . <br /> 15 - - - - - - <br /> 16 Councilmember Marks observed that this is a first reading of <br /> 17 the ordinance . It can still have changes and modifications <br /> 18 before it receives a second reading. He is supportive of <br /> 19 passage of the first reading. <br /> 20 <br /> 21 Councilmember Wagner sees the ordinance as a compromise. <br /> 22 Councilmember Enrooth questioned what impact the ordinance <br /> 23 would have on the lake ' s water quality. <br /> 24 <br /> 25 Mayor Ranallo, noting that this is the first reading, felt <br /> 26 there could still be some modifications made, particularly in <br /> 27 the areas of enforcement and restrictions . <br /> 28 <br /> 29 The City Attorney noted that cities ordinarily do not have any <br /> 30 authority over lakes and that only special statutes allows <br /> 31 this type -of ordinance to be enacted . <br /> 32 <br /> 33 A resident stated he sees no problem with enforcement by the <br /> 34 St . Anthony Police Department and the Columbia Heights Police. <br /> 35 Department . <br /> 36 <br /> 37 Another resident felt there are already enough laws on the <br /> 38 books and all that is needed is their enforcement . <br /> 39 <br /> 40 Motion by Marks , second by Ranallo to direct the City Manager <br /> 41 to gather additional information regarding restrictions on <br /> 42 other `lakes , contact Columbia Heights regarding its position <br /> 43 on this matter , investigate the position of the Department of <br /> 44 Natural Resources, and determine the 'affect of motorized <br /> 45 wa-tercraft on water quality. <br /> 46 <br /> 47 The City Manager stated he will also research the number of <br /> 48 calls received regarding disturbances on the lake in the la-st <br /> 49 three years , the potential effect restrictions may have on <br /> 50 property values and how restrictions are enforced by other <br /> 51 municipalities . <br /> 52 <br /> 53 <br /> 54 <br />
