I appreciate knowing the City Council's views on this <br /> issue. <br /> The legislature has been aware of the increased legal burden felt <br /> by cities and responded with some changes in. the crime bill. In <br /> the 1992 crime bill, the state required judges to set a minimum <br /> fine of 20% of the statutory maximum for the offense to cover <br /> legal costs incurred by the cities. In 1993, the percentage was <br /> raised to 30%, of which 20% would be divided between the law <br /> enforcement agencies that incurred the legal costs. For example, <br /> if the city prosecutes a misdemeanor with a maximum fine set at <br /> $700, 30% of that fine or $210, would be recovered and divided. <br /> However, the fine may include community service hours that <br /> hopefully will be a beneficial to the city. The 1992 crime bill <br /> change is found in MS 609.101, subd 4, and the 1993 change may be <br /> found in the 1993 Session Laws, Chapter 326, article 12. <br /> The MN Supreme Court Research Department willbe presenting a <br /> report to the Legislature next session. The Court will be <br /> monitoring the ways fines are being assessed throughout Minnesota <br /> and will report on successful methods used to increase the <br /> recovery rate to cities.
