LEASE <br /> r <br /> THIS AGREEMENT, made this day of 19_, <br /> by and between the CITY OF ST. ANTHONY, a municipal corporation under the <br /> laws of the State of Minnesota, (hereinafter called "Landlord") and MINNESOTA <br /> SWIMMING (hereinafter called "Tenant"), <br /> WITNESSETH: <br /> That the Landlord, in consideration of the rents and covenants hereinafter mentioned, <br /> does hereby Demise, Lease and Let unto the Tenant, and the Tenant does hereby hire <br /> and take from the Landlord the following described premises located in the County of <br /> Hennepin and the State of Minnesota, viz: <br /> That portion of the building (hereinafter called the "Building") located at 3301 Silver <br /> Lake Road, crosshatched on Exhibit 1 attached hereto and made a part of (hereinafter <br /> called the "Leased Premises"). <br /> TO HAVE AND TO HOLD THE SAID PREMISES, without any liability or obligation on <br /> the part of said Landlord of making any alterations, improvements or repairs of any <br /> kind on or about the said premises save as provided herein, for the term of twelve (12) <br /> months commencing August 1 , 1994, unless terminated at an earlier date as <br /> hereinafter provided. <br /> ARTICLE 1 . RENT. <br /> Tenant will pay to Landlord at 3301 Silver Lake Road, St. Anthony, Minnesota <br /> 55418, or at such other address as may be designated by Landlord, without <br /> prior demand and without any deduction or set-off, annual rent in the amount <br /> of $5,166.00 payable in monthly installments of 5430.50 each. <br /> ARTICLE 2. TERM. <br /> The term of this lease shall be twelve (12) months commencing on August 1 , <br /> 1994 and terminating on July 31, 1995 unless terminated at an earlier date as <br /> hereinafter provided. <br /> ARTICLE 3. UTILITIES AND SERVICES. <br /> Landlord agrees to furnish heat, water, sewer service, and electricity in <br /> reasonable amounts, trash pick up, and-snow plowing, but Landlord shall not <br /> be liable for any loss or damage caused by or resulting from any variation, <br /> interruption or failure of such services due to any cause beyond its reasonable <br /> control; and no temporary interruption of failure of such services, incident to <br /> the making of repairs, alterations or improvements or due to accidents or <br />
