CITY OF ST. ANTHONY • <br /> ORDINANCE 1998-010 <br /> AN ORDINANCE RELATED TO STORM WATER MANAGEMENT; AMENDING <br /> CHAPTER 16 OF THE CITY CODE BY ADOPTING A NEW SECTION <br /> The City Council of the City of St. Anthony hereby ordains: <br /> Section 1. Chapter 16, Zoning and Land Use, is amended by adding a new Section 1675 to read <br /> as follows: <br /> SECTION 1675 - STORM WATER MANAGEMENT <br /> 1675.01 Statutory Authorization. This Section is adopted pursuant to Minnesota Statutes <br /> Sections 462.351 through 462.365. <br /> 1675.02 Findings. The City hereby finds.that uncontrolled and inadequately planned use of <br /> wetlands, woodlands, natural habitat areas, areas subject to soil erosion and areas containing <br /> restrictive soils, adversely affects.the public health, safety and general welfare by impacting <br /> water quality and contributing to other environmental problems, creating nuisances, impairing <br /> other beneficial uses of environmental resources and hindering the ability of the City to provide <br /> adequate water, sewage, flood control,and other services. <br /> 1675.03 Purpose. The purpose of this Section is to address the findings in Section 1675.02 and <br /> to promote, preserve and enhance the natural resources within the City. <br /> 1675.04 Definitions. For the purposes of this Section, the following terms,phrases, words, and <br /> their derivatives shall have the meanings stated below. <br /> Applicant. Any person who wishes to obtain a building permit, zoning or subdivision <br /> approval. <br /> Control measure. A practice or combination of practices to control erosion and attendant <br /> pollution. <br /> Detention facility. A permanent natural or man-made structure, including wetlands, for <br /> the temporary storage of runoff which contains a permanent pool of water. <br /> Flood fringe. The portion of the flood plain outside of the flood way. <br /> Flood plain. The areas adjoining a watercourse or water basin that have been or may be <br /> covered by a regional flood. <br />
