d <br /> • ANIMAL CONTROL CONTRACT <br /> This agreement made this 8th. day of December , 1980 by and between <br /> Municipal and Private Service, Inc., a Minnesota Corporation, hereinafter referred to as MAPSI <br /> and the City of St Anthony a Municipal Corporation located in the Counties of <br /> Hennepin and Ramsey and the State of Minnesota, hereinafter referred to as City, <br /> witnesseth: <br /> In consideration of the covenants and agreements hereinafter set forth, it is mutually agreed by <br /> and between the parties hereto as follows. <br /> 1 . This agreement shall be effective as of 1, January 1981 and shall continue in <br /> effect until 31, December 1981 unless cancelled pursuant to Paragraph 15. <br /> 2. MAPSI agrees to patrol the public street; ofSt . Anthony in a vehicle <br /> especially designed for the transportation of small animals, in accordance with a schedule <br /> agreed upon by both parties. <br /> • 3. MAPSI agrees that patrolling shall be done by competent personnel trained in the handling <br /> of animals, and that such employees shall be approved by the City Manager at the City's re- <br /> quest. Employees shall be authorized by the City to apprehend and retain dogs, cats, and <br /> other animals, which are in violation of the City Ordinance. However, MAPSI will not invade <br /> the private property contrary to the wishes of the owner of said property nor forcibly take <br /> an animal from any person without the approval and assistance of a regular officer of the City. <br /> 4. In addition to the regular hours of patrolling referred to, MAPSI agrees to maintain one (1) <br /> vehicle for standby service to attend to cases outside regular patrol hours at the specific re- <br /> quest of the City's Police Department. <br /> 5. MAPSI represents and agrees that all animals impounded shall be kept at MAPSI housed at <br /> 506 - 11th Avenue North, Minneapolis, Minnesota, and MAPSI agrees and warrants that al' <br /> animals impounded shall be kept in a comfortable and humane manner for a period required <br /> by the City Ordinance. MAPSI agrees that the pound facilities shall be open and available to <br /> reclaim animals from 8:00 a.m. to 7:00 p.m. Mondays through Saturdays, and from 1:00 <br /> p.m. to 5:00 p.m. on Sundays and Holidays. MAPSI shall comply with the require— <br /> ments of Section 101(25 of the St. Anthony ordinances,. a copy of which is <br /> tt ched. <br /> 6. aAt the time that an animal impounded under this contract is reclaimed, MAPSI or its agent <br /> shall collect the impounding fee and boarding charges as provided by City Ordinance. MAPSI <br /> shall furnish monthly reports to the City a! required as to the service or services rendered <br /> in connection with each animal impounded. All impounding fees, license fees and any other <br /> penalty fees collected by MAPSI or its agent shall be remitted to the City. <br /> • <br />
