I 1 <br /> RESOLUTION 81-031 <br /> A RESOLUTION ESTABLISHING A POLICY FOR <br /> THE USE OF CITY RIGHT-OF-WAY FOR <br /> RESIDENT GATHERINGS <br /> WHEREAS, the City Council desires to establish a policy for the use <br /> of City rights-of-way for legitimate purposes , <br /> NOW, THEREFORE, BE IT RESOLVED, that the use of City rights-of-way <br /> is permitted subject to the following rules and regulations : <br /> (1) The use of the right-of-way is permitted on a request basis , <br /> made at .least 30 days prior to the requested date , and subject <br /> to City Council approval, by permit. <br /> (2) A petition, signed by 4/5th's of the property owners abutting <br /> the right-of-way must be presented to the City Clerk.. <br /> (3) Evidence of adequate insurance, naming the City of St. Anthony <br /> as a Named Insured, shall be submitted to the City Clerk. <br /> (4) Streets may be closed during daylight hours only or not after <br /> 10 : 00 -PF:M. <br /> • (5) The right-of-way closing shall not exceed '6 hours in a 24 <br /> hour period. <br /> (6) The use of any County road, M.S.A. road or other right-of-way <br /> carrying sufficient volume, as determined by the Public Works <br /> Director, shall be prohibited. <br /> (7) The consumption of alcoholic .beverages in the right-of-way <br /> is prohibited.' <br /> (8) If non-resident attendance is anticipated, a .parking plan shall <br /> be required. <br /> (9) Applications are to be made by a sponsor who resides in a <br /> dwelling abutting the right-of-way on such forms as may be <br /> provided by the City and accompanied by a clean-up deposit <br /> of $50 . 00 . <br /> The applicant shall be responsible for the conduct of the <br /> group and for the clean-up of any cans , bottles or debris <br /> left by the .group. The clean-up deposit shall be returned to <br /> the applicant only if the City is satisfied that all cans, <br /> bottles and other debris from the activities of the group <br /> were properly disposed of or removed. <br />
