RESOLUTION 85-038 <br /> • A RESOLUTION RATIFYING ACTION OF CITY MANAGER, <br /> MAYOR AND SPECIAL COUNSEL IN PREPARING AND <br /> PRESENTING A CLAIM UNDER FEDERAL TORTS CLAIMS ACT <br /> AND NOTICE OF CLAIMS UNDER VARIOUS <br /> FEDERAL ENVIRONMENTAL STATUTES <br /> WHEREAS, the City of St. Anthony (."City") water supply has been determined to be <br /> contaminated by hazardous chemicals by the Minnesota Department of Health; and <br /> WHEREAS, the City has been directed by the Minnesota Department of Health to <br /> discontinue use of contaminated wells and to provide non-contaminated water to <br /> its citizens; and <br /> WHEREAS, the City has complied with the directions of the Minnesota Department <br /> of Health by closing a well and arranging for alternative water supplies; and <br /> WHEREAS, the City has expended City monies in responding to the groundwater con- <br /> tamination problem within the City and anticipates further related expenditures; and <br /> WHEREAS, federal statutes require notices of the City's claims to be made as a <br /> condition precedent to subsequent litigation relating to said claims; and <br /> WHEREAS, the City's attorneys in this matter, working with its Mayor and City <br /> Manager, have prepared and presented such notices of claims; and <br /> • WHEREAS, the Council has been advised of the extent of the groundwater problem as <br /> well as certain studies and investigative efforts undertaken by the Minnesota <br /> Pollution Control Agency and the United States Environmental Protection Agency <br /> indicati 'n'g -that the Twin City Army Ammunition Plant is a likely source of the <br /> contaminants found in the City's water supply; <br /> NOW, THEREFORE, be it resolved by the City Council of the City of St. Anthony <br /> hereby ratifies the actions of its attorneys, Briggs and Mortan, P.A.,, its City <br /> Manager, David M. Childs and its Mayor, Robert J. Sundland, in preparing and <br /> presenting a Claim and Notice of Claims on or about August 9;`, 1985 with regard <br /> to this matter. <br /> Adopted this I ()42,41 . day of !S4-> p 985. <br /> ayor <br /> ATTEST: <br /> City Clerk <br /> Reviewed for administration <br /> � <br /> City Manager <br />
