iw <br /> RESOLUTION NO. 85-039 <br /> • CITY OF St. Anthony <br /> STATE OF MINNESOTA <br /> RESOLUTION AUTHORIZING AN INCREASE IN - <br /> BASIC CABLE TELEVISION SERVICE RATES BY <br /> GROUP W CABLE OF THE NORTH SUBURBS , INC. <br /> WHEREAS, pursuant to City Ordinance No. 82-009 , Group W <br /> Cable of the" North Suburbs, Inc. ( "Group W") has been <br /> granted a non-exclusive revocable franchise 'to -operate, <br /> construct, and maintaina cable television system within <br /> . the City; - and <br /> WHEREAS, the franchise agreement in effect provides <br /> .for the regulation of Basic Service rates by City; and <br /> WHEREAS, the franchise agreement provides for a passive <br /> rate review procedure to increase Basic Service rates wherein <br /> Group W must give written notice of a proposed increase to <br /> the City' and the North Suburban Cable Commission ( "Commission") <br /> ninety (90) days prior to the effective date of the increase and <br /> each proposed rate increase is automatically approved .by <br /> • City unless expressly disapproved within ninety (.90) days <br /> by resolution of the Council; and <br /> WHEREAS , Group W has given written notice on August 22, <br /> 1985 -to the Commission of a proposed increase in Basic <br /> Service. rates from -$7 . 95 to $9 . 95 per month; and <br /> WHEREAS, Group W further requested authorization to <br /> implement the proposed rate increase immediately rather <br /> than in ninety (90) days ; and <br /> WHEREAS , the Commission recommends to City that no <br /> action be taken to disapprove the increase in Basic Service <br /> rates and that Group W be permitted to implement the proposed <br /> rate increase immediately; <br /> THEREFORE, BE IT RESOLVED, that the City Council of the <br /> City of St. Anthony - accepts the recommendation <br /> of the Commission that no affirmative action be taken by the <br /> Council to disapprove the proposed increase in Basic Service <br /> rates from $7 . 95 to $9 .95 -per month under the terms of the <br /> franchise agreement; <br /> BE IT FURTHER RESOLVED, that the City Council will <br /> permit Group W to. immediately implement this proposed <br /> • increase in Basic Service rates .and the City will not <br />
