CR <br /> r f <br /> ACCESS AGREEMENT <br /> BETWEEN <br /> MINNESOTA POLLUTION CONTROL AGENCY <br /> CITY OF ST. ANTHONY <br /> WHEREAS, the Minnesota Pollution Control Agency (Agency) has statutory <br /> authority to enter upon public and private property for the purpose of <br /> conducting surveys and investigations; and <br /> WHEREAS, the Agency is conducting an investigation into ground water <br /> contamination in the area of City of St. Anthony (City) property; and <br /> WHEREAS, the Agency wants to install monitoring wells and sample ground <br /> water on the City property; and <br /> WHEREAS, the City is desirous of cooperating with the Agency in the Agency's <br /> effort to investigate ground water contamination. <br /> • NOW, THEREFORE, the Minnesota Pollution Control Agency and the City hereby <br /> agree as follows: <br /> 1. The City of St. Anthony agrees: <br /> a. That the Agency may have access to its property located at T29N, <br /> R23W Sec 6 DDC for the purpose of conducting a ground water investigation. <br /> b. That the Agency may install one (1) well on the City property <br /> described above. <br /> C. That the Agency may enter the City's property at reasonable hours <br /> to conduct routine monitoring at the wells. <br /> 2. The Agency agrees: <br /> a. That it shall not select sites for the monitoring wells on the <br /> City property that unduly interfere with the City's normal use of the property. <br /> b. That it shall notify the City at least three days in advance of <br /> • the installing of any wells and of the location of such wells. <br />
