RESOLUTION 87-017 <br /> A RESOLUTION REGARDING A STREET WIDTH VARIANCE <br /> GRANTED BY THE MINNESOTA DEPARTMENT OF <br /> TRANSPORTATION TO THE CITY OF ST. ANTHONY <br /> WHEREAS, the City of St. Anthony desires to reconstruct St. <br /> Anthony Boulevard (MSAS 106 ) south from the BNRR Bridge to <br /> Ridgeway Parkway with a 32 foot street section; and <br /> WHEREAS, on April 2, 1987 a variance was granted by the <br /> Commissioner of Transportation from the Minnesota Rule 8820.9912 <br /> to permit such a 32 foot street width with no parking instead of <br /> the required width of 36 feet with no parking; and <br /> WHEREAS, said variance was conditioned upon the City holding the <br /> State harmless from any claims that arise as a result from such <br /> variance. <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of the City <br /> of St. Anthony that the City of St. Anthony hereby indemnifies, <br /> saves and hold harmless the State of Minnesota and all its agents <br /> and employees of and from -any and all claims, demands, actions or <br /> • causes of actions of any nature or character arising out of or by <br /> reason of , in any manner, the reconstruction of St. Anthony <br /> Boulevard (MSAS 106) from a point south of the Burlington <br /> Northern Railroad Bridge to Ridgeway Parkway in any other manner <br /> than as a 36 foot wide street with no parking in accordance with <br /> Minnesota Rule 8820.9912 and further agrees to defend at its sole <br /> cost and expense any action or proceeding commenced for the <br /> purpose of asserting any claim of whatsoever character arising as <br /> a result of granting this variance. <br /> Adopted this day of r' 1987 . <br /> O• <br /> Mayor <br /> ATTEST• <br /> City Clerk <br /> Reviewed for administration: <br /> m . . <br /> City Manager <br /> ter' <br />
