12 <br /> 1 garage, which was there before, had apparently been grandfathered in to <br /> •2 the current City Ordinance; <br /> 3 *told Commissioner Madden the roadbed at that point is almost 33 feet <br /> 4 across and there's about 16-1/2 feet on either side of the right-of-way <br /> 5 and the Commissioner's calculations that the distance from the edge of <br /> 6 the bituminous might be 29-1/2 feet rather than the 31 feet he had <br /> 7 calculated were probably correct. <br /> 8 Neighbor Asks Questions <br /> 9 Andrew Szurek whose home at 2809 Silver Lane was identified as the <br /> 10 first property west of the subject property and whose signed indication <br /> 11 that he had no objections to the proposed addition had been included in <br /> 12 the agenda packet; <br /> 13 *wanted to know how Mr. Hance's garage would line up with Mr. Solie's <br /> 14 on the west side and whether the City would inspect the project before <br /> 15 the garage was constructed; <br /> 16 *indicated Mr. Hance was coming in with some "surprises" about which <br /> 17 he said he had talked to the lawyer before the meeting, including the <br /> 18 fact that the structure would be built three feet higher than he had <br /> 19 first anticipated, which caused him some concern about drainage; <br /> 20 *said he was concerned that the adjoining land might be landscaped <br /> 1Whigher than his property where the land between the two parcels had <br /> been level before and he would like to see assurances in writing that <br /> 23 it wouldn't create a drainage problem for him. <br /> 24 Mr. Hance addressed what he said he perceived were two concerns of Mr. <br /> 25 Szurek, drainage and access to his property. He said he and the <br /> 26 Building Inspector, Larry Hamer, had both assured that adequate <br /> 27 provisions for drainage would be made when the Hance lot is raised to <br /> 28 street level, leaving Mr. Szurek's lot lower. The applicant told the <br /> 29 Commissioners that the swales which are now only primitively constructed <br /> 30 on both sides of his property would ultimately be finished to guarantee <br /> 31 no drainage on either neighbors' properties (which, of course, would <br /> 32 also be a City requirement) . <br /> 33 Mr. Hance said the other issue which bothered Mr. Szurek was how the <br /> 34 Hance driveway would be constructed, which the attorney said was still <br /> 35 not resolved. He explained that four of the homes had 10 foot easements <br /> 36 along side and parallel to Silver Lane, but on their own respective <br /> 37 properties, which had served as a sort of service road. Although his <br /> 38 driveway wouldn't encroach on any of his neighbors' easements, Mr. Hance <br /> 39 said he wanted to get that eliminated but hadn't quite worked out the <br /> 40 agreements which would provide egress and ingress to their lots. He <br /> 41 said he was trying to negotiate an agreement with the Szurek's whereby <br /> 42 he would construct a new driveway for them in exchange for their <br /> 43 releasing the agreement, but the neighbor on the other side had to agree <br /> 40 to. that as well. <br />
