Motion failed. <br /> 3 Chair Bergstrom clarified there may be outdoor speakers that are similar to that used at a bank. Mr. <br /> 4 Kalscheur answered affirmatively. <br /> 5 Hanson stated his support for hours of operation of 7:00 a.m. to 11:00 p.m. <br /> 6 Motion by Bergstrom,second by Melsha,to recommend approval of a conditional use permit for the <br /> 7 construction of a 14,490 square foot Walgreens store on the corner of Silver Lake Road and 37th <br /> 8 Avenue North with a two lane drive-thru pharmacy on the north side of the building, based on the <br /> 9 finding that the use is not detrimental or injurious,the use is necessary and desirable at this location, <br /> to and subject to staff comments contained in its memorandum,the City Engineer's December 7 and <br /> 11 December 19, 2000 comments, and the following conditions: <br /> 12 1. The proposed westerly entrance to the site from 37th Avenue NE be aligned with Belden <br /> 13 Drive on the south side of 37th Avenue NE. <br /> 14 2. Access permits to Silver Lake Road be acquired from Ramsey County and City access permit <br /> 15 for 37th Avenue NE, and copies submitted to the City of St. Anthony. <br /> •16 3. The proposed site discharges directly to Silver Lake. Therefore, treatment to NURP. <br /> 17 recommended standards will be required. However,due to site restrictions,a 5:1 slope could <br /> 18 replace the 10:1 bench requirement at the normal water elevation. <br /> 19 4. The developer receiving approval of the development plan from the MPCA. <br /> 20 5. Due to existing soil contamination,the pond be lined to address any concerns of the MPCA. <br /> 21 6. The outlet from the proposed ponding area should provide skimming for floatable materials. <br /> 22 This may be accomplished by submerging the outlet pipe below the normal water elevation. <br /> 23 In regard to the proposed outlet structure, the top of casting on the manhole should be an <br /> 24 open grate set at an elevation below the overflow so as to provide an emergency outlet in the <br /> 25 case that the primary outlet is plugged or iced up during spring conditions. <br /> 26 7. Lighting be consistent with City and Ramsey County lighting standards for Silver Lake Road <br /> 27 as judged by Dan Soler and/or Jay Hartman and in coordination with lighting standards on <br /> 28 37th Avenue NE. <br /> 29 8. The hours of operation will be from 7:00 a.m. to 11:00 P.M. <br /> 30 9. Conditions listed in the letter from Dorsey & Whitney LLP of November 9, 2000, relating <br /> 31 to 20 foot utility easement along the east line of Lot 3 property line to be incorporated into <br /> 32 the conditional use permit. <br /> 33 10. All elements in design and submittals for application to be incorporated into the conditional <br /> 34 use permit. <br /> 35 Motion carried unanimously. <br /> • <br /> 36 9. NEW APPLICATIONS. <br /> 37 None. <br />
