-8- <br /> • 1 like to put up would fit into the existing space available for signage on the <br /> 2 storefront, but it was his intention to work with the City staff to provide <br /> 3 signage which would meet the City requirements. <br /> 4 <br /> 5 Commissioner Jones then indicated he considered the proposed business to be a very <br /> 6 compatible enterprise-for that location because its hours of operation would be <br /> 7 more compatible to the traffic patterns than the previous businesses. However, <br /> 8 because "the location directly impacts on the residential area" the Commissioner <br /> 9 said he perceived the store owner should be required to turn off the sign <br /> 10 when the store closed. Mr. Crowley indicated the' Autotraac sign is lit all night. <br /> 11 When Commissioner Jones replied that the auto store sign had been grandfathered <br /> 12 into the ordinance, Commissioner Bowerman said he still perceived "this would be <br /> 13 an unusual restriction of business" . <br /> 14 <br /> 15 The Chair indicated she associated a lighted sign to mean the store is available <br /> 16 for service and said she had often been disappointed to find that premise not to <br /> 17 be true when she stopped at a drug store which was closed, but kept the sign. lit. <br /> 18 <br /> 19 Motion by Commissioner' Jones and seconded by Chair Franzese to amend the motion <br /> 20 to indicate the store owner would be required to turn off his sign when his store <br /> 21 was closed. <br /> 22 <br /> 23 Voting on the motion: <br /> 24 <br /> 25 Aye: - Jones and ,Franzese:... <br /> 26 <br /> • 27 Nay: 3owerman•'and'.Jliadden•. <br /> 28 <br /> 29 Notion to amend! not carried: - <br /> 30 <br /> 31 Voting,' oh-'the or.i!gi nal ,motion: <br /> 32 <br /> 33 Aye: Madden, Bowerman-, and Franzese. <br /> 34 <br /> 35 Nay: Jones. <br /> 36 <br /> 37 Motion carried. <br /> 38 <br /> 39 At 8:58 P.M. the Chair opened the. hearing to consider the request from Elmwood <br /> ' 40 Lutheran Church for a conditional use permit to .allow the construction of a new <br /> # <br /> 41 church sanctuary on the north side of their existing church building at 3615 <br /> 42 Chelmsford Road by reading the notice of the hearing which had been published in <br /> 43 the June 4th Bulletin and sent to all property owners of record within 350 feet <br /> 1 44 of the subject property. <br /> a <br /> q 45 <br /> 46 The Manager indicated the only calls he had gotten in response to the notice had <br /> i <br /> 47 come from persons who indicated approval of the church's plans . However, one of <br /> 48 these had suggested that in order to assure there would be no misunderstanding <br /> 49 as to just what was being constructed, it might be advisable for the City to <br /> 50 rescind all previous approvals since they are no longer valid. Mr. Childs had <br /> 51 included in the agenda packet copies of minutes relevant to those actions and <br /> 52 had advised the Commi.ssi.oners in his June 13th memorandum that the proposal <br /> i • <br /> 53 before them that evening complied with all City ordinances and no variances <br /> 54 would be necessary. <br /> 55 <br />
