1 Commissioner Brownell said he also would not be in favor of granting a <br /> variance for another sign on this restaurant because he questioned <br /> whether conditions 2 or 3 in the application could be considered to be <br /> 4 satisfied with the request. He indicated he could see no unique <br /> 5 topography which warranted special consideration and doubted whether "a <br /> 6 particular hardship was created for the property because the restaurant <br /> 7 can't be seen from Apache Plaza" because his own personal observation <br /> 8 had been that neither the restaurant nor a sign on its mansard roof <br /> 9 could be seen from Apache. <br /> 10 Commissioner Madden said that although he recognized the circumstances <br /> 11 for Burger King were somewhat different, he nevertheless perceived that <br /> 12 signage had a direct bearing on this restaurant because the two <br /> 13 establishments are so close. He indicated he also thought the fact that <br /> 14 total signage would now be only 107.1 square feet, where 150 square feet <br /> 15 are allowable should be taken into consideration. The Commission Chair <br /> 16 indicated he perceived the requested sign would not be a very <br /> 17 "domineering" type sign and said he did not find it objectionable. <br /> 18 Mr. Childs said he wasn't certain he had clarified his earlier remarks <br /> 19 about the sign not being able to be seen from Apache to mean that when <br /> 20 a driver is about to turn onto the service road between Midwest Federal <br /> 21 and the gas station, the gas station obstructs the visibility of both <br /> 22 the restaurant and its existing sign from the driver's view before he <br /> 23 can decide to make the turn which would take him into Hardees. <br /> 24 Commissioner Madden reported having missed the driveway altogether when <br /> he was attempting to get to Hardees from the Apache Mall. <br /> 26 Commissioner Wagner said, like Commissioner Madden, he saw nothing <br /> 27 objectionable about the sign which was being requested and thought a <br /> 28 sign on the roof would help the business. However, he said, it still <br /> 29 bothered him that the owner hadn't left the sign where it was four years <br /> 30 ago. <br /> 31 Commissioner London indicated he could see no compelling reason to grant <br /> 32 this variance because he perceived the owner had created the hardship <br /> 33 himself. He also said he thought the City should not be compelled to <br /> 34 repeat a mistake like the one he perceived had been made with the Burger <br /> 35 King signage. Commissioner Brownell echoed his opposition. <br /> 36 This led to a discussion of setting precedents which the City Attorney <br /> 37 had indicated was not as important as considering each variance on its <br /> 38 own merits. <br /> 39 Planning Commission Recommendation , <br /> 40 Motion by Wagner, seconded by Franzese to recommend the City Council <br /> 41 grant a variance from the Sign Ordinance of the City Code to allow the <br /> 42 proposed 37.1 foot wall sign on the westerly portion of the south facing <br /> 43 mansard roof of the Hardees Restaurant, 4004 Silver Lake Road, finding <br /> 44 that: <br /> 11 <br />
