Planning Commission Special Meeting Minutes <br /> • January 30, 1996 <br /> Page 5 <br /> 1 a 60 foot right-of-way is maintained between the Cub Foods store and the existing mall, and the <br /> 2 sprinkling system is maintained. <br /> 3 The City Attorney has suggested that each lot have its own sewer and water connections. Where a <br /> 4 lot does not have direct access and connections to the main utilities under Silver Lake Road, or in <br /> 5 other public easements, such easements will need to be created either in the plat or as suggested <br /> 6 earlier by Mr. Soth, City Attorney, through a reciprocal easement agreement. The Public Works <br /> 7 Director has verified that each lot can be served with sewer, water and other necessary utilities. <br /> 8 An Environmental Assessment Worksheet has been completed. The City Attorney has advised that <br /> 9 until the requirements of the law relating to the Environmental Worksheet are met,the project should <br /> 10 not have final approval from the Council. <br /> 11 The City Attorney has also advised the City that the existing Declaration of Restrictions filed and <br /> 12 recorded a year ago as part of the previous plat approval will be terminated when the new plat is <br /> 13 filed. These restrictions are not necessary for the City's protection provided the land is replatted. <br /> 14 Title insurance information has been provided by Ste. Marie Corporation as per Mr. Soth's request. <br /> Based on the information provided by Ste. Marie Corporation and the conditions and advice <br /> 6 provided by the City Attorney, Staff recommends approval of Ste. Marie Corporation's petition for <br /> 17 subdivision of land in order to facilitate the redevelopment of the Apache Shopping Center. <br /> 18 Chair Bergstrom requested Mr. Scott to present a brief overview of the subdivision on the site plan. <br /> 19 Mr. Scott reviewed the site plan for the audience, and explained the seven lots and three outlots that <br /> 20 will be created. <br /> 21 Chair Bergstrom asked if the Commission had any questions for Mr. Scott. Chair Bergstrom closed the public hearing at 7:43 p.m. <br /> 24 <br /> 25 Motion by Gondorchin, seconded by Thompson, to approve the proposed subdivision for the <br /> 26 property known as Apache Plaza as long as all twelve issues identified in a January 24, 1996 letter <br /> 27 to the Planning Commission by legal counsel William Soth are resolved by the City of St. Anthony <br /> 28 administration. <br /> 29 Motion carried unanimously. <br /> 30 B.
