Planning Commission Regular Meeting Minutes <br /> July 15, 1997 <br /> • Page 5 <br /> 1 Chair Bergstrom noted the Amoco Station was in the same situation and was allowed 24 hour <br /> 2- operation. It would not be right to allow one business 24 operation and not allow another the <br /> 3 same. <br /> 4 Commissioner Horst stated he agreed. <br /> 5 Commissioner Makowske stated he would also like a condition of approval or prerequisite to <br /> 6 building that the site be in conformance with regulations for drainage of hazardous chemicals. <br /> 7 Mr. Struther displayed and explained the landscape plan. The Plan included a collection of <br /> 8 shrubbery plantings on 39th Avenue with deciduous trees planted on the islands between the <br /> 9 site and Apache Plaza. Shrubs will be planted near the building and ornamental plantings are <br /> 10 included along the building. The balance of the green area will be lawn. <br /> 11 Commissioner Gondorchin stated he would vote against the conditional use permit as he did <br /> 12 not believe this would be a good addition to Apache Plaza. He noted the residents are <br /> 13 concerned with 24 hour operations in this area and this has the potential to become a 24 hour <br /> 14 operation. <br /> 15Motion by Bergstrom, seconded by Horst, to recommend approval of the conditional use <br /> permit for operation of a Gas/Convenience Store with Car Wash for Reliance Development <br /> 7 Company, L.L.P. on Lot 4, Block 1, Apache Plaza as it meets the following conditions of the <br /> 18 conditional use permit: <br /> 19 1. The proposed use is one which is specifically listed for the zoning district where the <br /> 20 use will be located; <br /> 21 2. The proposed use will not be detrimental to the health, safety, or general welfare of <br /> 22 the persons residing or working in the vicinity; <br /> 23 3. The proposed use is desirable at the above location to provide a service and is in the <br /> 24 interest of public convenience and will contribute to the general welfare of the <br /> 25 neighborhood community; <br /> 26 Subject to the following conditions: <br /> 27 1. The proposed layout will be done in accordance with the drawings submitted to the <br /> 28 City as part of the approval; <br /> 29 2. The proposed layout be subject to approval of the Fire Chief for movement and access <br /> 30 of emergency vehicles; <br /> 31 3. Petroleum storage and drainage requirements conformity with local and state <br /> 32 requirements. <br /> Commissioner Franzese suggested addition of Condition #4, "No one present spoke against <br /> the request". <br /> 35 Chair Bergstrom and Commissioner Horst accepted the amendment to the motion. <br />
