Planning Commission Regular Meeting Minutes <br /> • May 19, 1998 <br /> Page 4 <br /> 1 that he did not know of any other houses this far back on a lot and that this placement was <br /> 2 abnormal. <br /> 3 Commissioner Kaczor stated he has seen a case where the house is located in the middle of a lot. <br /> 4 He agreed with keeping the houses lined up but also questioned why a house would be squeezed <br /> 5 in. <br /> 6 Commissioner Horst stated there are some unusual cases but they generally occur with existing <br /> 7 homes. This is new construction and the City has an opportunity to place the house in the way it <br /> 8 will eventually like the community to look. He expressed concern with setting a precedence. <br /> 9 Mr. Malenick stated he has seen houses placed this far from the frontyard setback but they are <br /> 10 generally located on corner lots. <br /> 11 Commissioner Bergstrom stated that other homes placed this far back were built before the City <br /> 12 Codes were in place. <br /> 13 Commissioner Horst noted that this subject was not part of the variance before the Commission <br /> 14 this evening but asked Mr. Malenick if he would take the concerns expressed into consideration <br /> 18 when building this home. <br /> 16 Motion by Chair Bergstrom, seconded by Commissioner Thompson, to recommend approval of a <br /> 17 variance of 1.5 feet to the north sideyard for the property located at 3613 Edward Street, Mr. and <br /> 18 Mrs. John Malenick,to allow construction of their home based on the following hardships: <br /> 19 1. The size of the lot which the City has recently allowed to be a buildable lot; <br /> 20 2. Economic considerations are not a basis for this request; <br /> 21 3. The hardship is caused by the City Ordinance whereby the City approving the lot width <br /> 22 allowed this to be a buildable lot. <br /> 23 Motion carried unanimously. <br /> 24 Chair Bergstrom requested that Staff determine the intent of the frontyard setback requirement as <br /> 25 it is not clear. He stated his interpretation of the Ordinance was that the setback is required to be <br /> 26 equal to the stated amounts and it is not merely a minimum requirement. Bergstrom noted this <br /> 27 request will be considered by the City Council at their May 26, 1998 meeting. He also asked the <br /> 28 applicant to investigate the option of moving the house forward on the lot and suggested that he <br /> 29 be in contact with Staff before starting construction. Bergstrom generally applauded the <br /> 30 applicant for building a nice home on this lot. <br /> 31 <br /> B. 98-05 David G. Newgaard - Lot Width Variance Request, 3123 Silver Lake Road. <br /> Ms. Moore-Sykes reported.that David G.Newgaard submitted a lot width variance application <br /> 34 for the vacant lot at 3123 Silver Lake Road.
