-3- <br /> Mr. Hamer reported that, although there are still some incidences <br /> • of puddling of the tar materials previously applied to cracks on City <br /> streets; the sand treatment his department is applying seems to be <br /> curing up fast, thus diminishing the annoyance for residents on those <br /> streets . The manufacturer of the faulty materials has been very slow <br /> in- reporting back the results of the testing of those materials , and, <br /> although the City could have Twin City Testing take the same tests at <br /> a cost of $500, the Public Works Director questioned whether the <br /> expenditure would be justified since the sanding appears to be solving <br /> the problem somewhat. Staff was requested to contact the Trumbull <br /> Company to expedite the return of the test results . <br /> At 7: 45 P .M. , the public hearing on the request from Robert Slick for <br /> a conditional use permit which would allow for the operation of a non- <br /> alcoholic bar in a commercial district at 2523 Harding Street N.E. , <br /> which had been given a unanimous recommendation for approval by the <br /> Planning Commission during their public .hearing on the proposal July 19th. <br /> William Bowerman was present to report the minutes of that meeting and <br /> he reiterated the findings the. Commission had found for recommending <br /> approval as well as the conditions under which the Commission believed <br /> the permit could be granted. <br /> Mayor Sundland commented he had perceived the condition which Mr . <br /> Bowerman himself had attached had been well put. The Commissioner <br /> explained that he believed after Mr. Slick had made the investment <br /> in his business , he should be. given reasonable assurance of continued <br /> operation, if he met all the requirements of the permit. Councilman <br /> Ranallo pointed out .that there are City ordinances which could be - <br /> enforced at any time that there were documented instances of dis - <br /> turbances for the neighbors at the facility . <br /> Mr. Slick was the only person present to speak to the request and he <br /> reiterated what he had told the Commission, that he perceives he would <br /> have no problems with the restrictions placed on his operation because <br /> he intends to make sure none of the activities in his establishment are <br /> a source of annoyance for the residents who live close by . He is <br /> carpeting both the floors and walls of his building to deaden the <br /> sound of the music and will see to it that the back door is always <br /> closed- when the music is playing. The bar owner was asked whether he <br /> was aware that the area his facility is in is proposed to be redeveloped <br /> for residential use , and Mr. Slick replied that he had been told that <br /> was the -case, but also had heard "it .might be twenty years before that <br /> happens" . The Council ' s perception of the- possibility that the project <br /> could move along much faster was conveyed to the applicant before the <br /> hearing was closed at 7: 50 P.M. for a vote on the proposal. <br /> Motion by Councilman Marks and seconded by Councilman Ranallo to grant <br /> a conditional use permit to Robert Slick., . 3400 -Buchanan Street N.E. , <br /> for -the operation of a non-alcoholic bar.,. "The Alternative" , as <br /> -proposed,. at-2523 Hardirig-Street N.E: ', finding, as did the Planning <br /> �Commission, . that this would appear . to be an acceptable use in a com- <br /> mercial district; adequate parking and access would. be provided on the <br /> • 'site,; - and, that- there would. be sufficient -distance between . the- facility <br /> and the residential neighborhood which is nearby. The Council agrees <br /> with the Commission that the following conditions should be set for <br /> approval: <br />
